ANIMAL CONTROL SERVICE CONTRACT <br />THIS AGREEMENT, made and entered into this 1st day of April, 1986, <br />by and between LAKE ANIMAL CARE, INC., a Minnesota corporation, <br />hereinafter referred to as "LAKE ", and the CITY OF LITTLE CANADA, a <br />municipal corporation, Ramsey County, Minnesota, hereinafter referred to <br />as "CITY /TOWN ". <br />WITNESSETH: That LAKE, in consideration of the covenants and <br />agreements of CITY /TOWN hereinafter contained, hereby covenants with <br />CITY /TOWN that LAKE will provide Animal Control Service to CITY /TOWN <br />pursuant to the following provisions: <br />1. That LAKE shall provide pick up service of <br />animals in CITY /TOWN in a vehicle appropriate for <br />the transportation of small animals. On -call <br />pick up service shall be provided Monday through <br />Friday, 08:00 a.m. to 10:00 p.m., and Saturday, <br />Sunday and holidays, 08:00 a.m. to 12:00 noon. <br />Standby emergency service shall be provided on a <br />twenty -four (24) hour basis at the specific <br />request of CITY /TOWN's law enforcement agency <br />and /or previously specified official of CITY /TOWN. <br />2. That LAKE shall patrol the public and private <br />streets of CITY /TOWN approx. two (2) hours per <br />day, five (5) days a week, provide emergency <br />call -up as requested by CITY /TOWN, and pick -up <br />and impound dogs and other animals found running <br />at large or otherwise in violation of CITY /TOWN <br />ordinances. <br />3. That LAKE shall provide additional patrol service <br />to CITY /TOWN at the rate of $12.00 per hour <br />during regular patrol hours. <br />4. That patrolling shall be performed by competent <br />LAKE personnel trained in the handling of <br />animals. That such personnel shall be subject to <br />approval by CITY /TOWN at CITY /TOWN's request. <br />5. That LAKE shall equip, service and maintain all <br />vehicles used for Animal Control Service with <br />two -way radios or other communication equipment. <br />6. Pursuant to Minnesota Statute 35.71 LAKE shall <br />impound all animals picked up in CITY /TOWN at its <br />Animal Shelter Located at 1283 Hammond Road, Town <br />of White Bear (Township), Minnesota. Said animal <br />shall be confined in a humane manner for a period <br />of not less than five (5) business days or until <br />claimed by an owner. Animals not claimed before <br />the expiration of five (5) business days shall <br />become the property of LAKE. If an animal is not <br />so claimed, LAKE may dispose of said animal in a <br />humane manner, pursuant to Minnesota Statute <br />Section 35.71, Subd. 3. <br />
