t'ES <br />.ty Council <br />May 11, 1983 <br />A & W (Cont.) Mr. Locke reported that the addition is treated like a three- season <br />porch. Locke stated that if heat was put in the building, frost <br />might react. Mr. Locke stated that if the addition was requested <br />today, he would require footings. However, Locke stated that he did <br />not know what the City could do at this point. <br />Mr. Fahey asked if it would be difficult to put the footings in at <br />this point. Locke replied that it would be co more difficult to put <br />footings in now than at the time the addition was constructed. <br />However, it would be costly. <br />Mrs. Nardini asked if the City should notify the owner of the situation. <br />Mr. Fahey suggested that perhaps the City should require that footings <br />be installed if the building is approved for year -round use. <br />Mr. Sweeney suggested that the City could put the owner on notice by <br />sending him a letter. <br />Fahey stated that the City should either make the owner correct the <br />problem or not. <br />Mr. Forsberg pointed out that the Test 'of the building may just be on <br />a slab. <br />Mr. Fahey suggested that the City should drop the matter. However, <br />Fahey felt that if there were any further additions or changes in the <br />building, the City should require footings. <br />The City Attorney reported that the City does have the legal right <br />to require that the addition either be torn down or footings installed <br />under it. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 83 -5 -198 - INSTRUCTING THE CITY <br />CLERK TO SEND A LETTER TO THE OWNER OF THE A & W <br />PROPERTY INFORMING THEM THAT THE TEMPORARY <br />STRUCTURE DOES, NOT HAVE LEGAL - FOOTINGS AND SHOULD <br />THE USE OF THE BUILDING BE CHANGED, THE CITY COUNCIL <br />WILL REQUIRE THAT SUCH FOOTINGS BE INSTALLED, AND <br />FURTHER INSTRUCTING THE CITY CLERK TO SEND A COPY <br />OF TIIE LETTER TO MR. BODE <br />The foregoing resolution was duly seconded by Mrs. Nardini. <br />Ayes (5) Fahey, Nardini, Hanson, Forsberg, Scalze. <br />nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 9, Page 239. <br />Page -9- <br />1 �' <br />
