FIFTEENTH RIDER TO AGREEMENT <br />THIS AGREEMENT, Made this day of , 1986 by and <br />between the BOARD OF WATER COMMISSIONERS OF THE CITY OF SAINT PAUL, hereinafter <br />called "Board" and the CITY OF LITTLE CANADA, County of Ramsey, State of <br />Minnesota, hereinafter called "City ", being the Fifteenth Rider to that certain <br />Agreement made by and between said Board and said City the 13th day of July, <br />1966 and by this reference incorporated herein and made part hereof and with the <br />same intent, purpose and effect as if said Agreement were set forth herein <br />verbatim. <br />WHEREAS, The Board is owner of a 175 foot wide right -of -way across the <br />north one -half (NZ) of the northwest one - quarter (NW'a) and northeast one - quarter <br />(NEf) of Section Eight (8), Township 29 North, Range 22 West, County of Ramsey, <br />hereinafter designated as "Premises "; and <br />WHEREAS, The City desires permission to 'enter upon certain portions of said <br />Premises to install and operate a twenty -four (24 ") storm water sewer; and <br />WHEREAS, The Board is willing to grant said permission to the City <br />consistent with the requirements and safety of the works of the Board; <br />NOW, THEREFORE, BE IT AGREED, In consideration of the mutual promises and <br />agreements of the parties hereto, that: <br />1. Said Board hereby grants to said City the permission to install <br />and operate a twenty -four inch (24 ") RCP storm water sewer <br />across the Premises as outlined in yellow color and located as <br />shown on attached drawing marked Exhibit "A ". <br />2. All disturbed areas of the Premises are to be restored by seeding <br />and mulching. <br />BE IT FURTHER AGREED, That the permission and authority granted by said <br />Board to said City are subject to all the terms and conditions contained in that <br />certain Agreement made by and between said Board and said City the 13th day of <br />
