As Allen <br />is a local street, it could be reduced to 50 feet in width, eliminating the need <br />for a variance. The ramifications of this action would depend on the extent to <br />which the City is willing to vacate in similar circumstances. As noted above, <br />most of this area is platted in 66 foot street widths. <br />The third option would be to deny the division. This would avoid any potential <br />precedents, however, the City could not pursue implementation of the Thoroughfare <br />Plan by requiring dedication of the rear portion of the lot. <br />RECOMMENDATION <br />Assuming the City wishes to pursue implementation of the Thoroughfare Plan, the <br />third option would be least desirable. Between street vacation and variance <br />approval, the vacation process would likely be more controversial, and in the long <br />run, expensive to all, concerned. <br />Remaining is the variance proposal. It is our recommendation that the City approve <br />the setback variance and lot split for the following reasons: <br />• The street right -of -way is in excess of current requirements and the house would <br />exceed setback standards if Allen Avenue were a 50 foot street. <br />e The Thoroughfare Plan constitutes a special condition, although it is not <br />necessarily unique to this property. <br />• The lots created can still be easily in excess of the ordinance standards for the <br />R- 1'District, requiring no further variances for width, area, or setbacks. <br />Conditions for approval should include: <br />• Irclusion of a 25 foot dedication along the west property line. <br />e Relocation of the dividing property line to be sure that each lot has at least <br />11,000 square feet, the minimum for corner lots in an R -1 district. <br />o Inclusion of utility and drainage easements in the subdivision plan. <br />o Any additional comments of the City Attorney and City Engineer. <br />cc: Joe Chlebeck <br />Tom Sweeney <br />Don Carley <br />John Palacio <br />Adelle Hanson <br />. 24 <br />
