PAUL, MINN. 55117 Minutes of the regular meeting, Planning Commission - City of Little Canada, June 2, 1977 The regular meeting of the Planning Commission of the City of Little Canada was held on the 2nd day of June, 1977 at 8:00 P.M. at 515 Little Canada Road in said City. The following members were present: Jack Radford, Eugene DeLonais, Earl Rossez, Virginia Fisher, Peter Costa, Ralph Nardini, Joseph Vitale, Jr., Richard Boss III, Dr. Tom Keenan, Dennis Ryan. The following members were absent: Margret Mitchell. The meeting was called to order at 8:00 P.M. EVAR Mr. Peterson presented a map of land intention asking the PETERSON County to buy property fdr open space and submit to City on advice of the County. Four and one half acres are buildable. Joseph Vitale made a motion that we table this for further study. Seconded by Ralph Nardini. Earl Rossez was asked to check project to find out assesse- ments. Carried. RALPH Mr. Nadeau proposes two buildings for Knox Lumber Company, NADEAU one for storage and one to use for manufacturing. Buildings will be complete and can be locked. One building will be 100 x 400 the other will be 80 x 200 and will be heated. A motion was made by Virginia Fisher to have a represent- ative from Knox Lumber appear before the Planning Commission with a letter of intent and specify what the building will be used for, plus a sprinkler system. Seconded by Richard Boss III. Carried. MIKE Attorney for concerned citizens gave reasons for rezoning. FAHEY Richard Boss III made a motion we recommend the Council that parcels 53- 0060 - 020 -60 and 53- 0060 - 050 -60 shown on the map be rezoned to R1. Seconed by Jack Radford. With the available manpower we did a brief study of the situation with results similar to the study we did last summer. As you are aware Lakeshore Avenue runs approximatley three blocks south" from Little Canada Road the"ends. The only direction a motorist can turn is a tight 90 degree turn to the right or west onto old Coutny Road C. For the cars going east on County Road C the situation is reversed, the east- bound traffic must make a 90 degree left turn. indicateAs defects at the presenttetime, T 1 causedmainlyrbytanraccumulation�ofrsanddfrom the winter that covers part of the pavement. We contacted the County Engineer about this and they are going to sweep the intersection and restripe it. They are also going to stripe the edges of the blacktop so that each lane is clearly marked. Our study was done on May 21st, 23rd, and 24th. 300 cars were clocked with radar and observed as they made the corner. About half the cars were checked in the morning and half in the evening between six and eight P.M: Average speed in the intersection is less than 18 miles per hour. It is impossible to make the turn and stay on the orad or in your proper lane at 30 miles per hour. Most of the cars making the turn at a speed in excess of 20 miles per hour will screech their tires somewhat. Mr. Waites home is the last house on the west side of Lakeshore, it faces Lakeshore and Old County Road C runs along the southside of his property. 0017 The volume of traffic at this location is 1500 vehicles per 24 hours. That count was taken in 1975 by the County Engineer's office. They are now taking a current count which will be available very soon. The volume of traffic is caused by the fact that this route is an easy access to Freeway 35E from the large apartment complexes on County road B2 and Demont. There have been six accidents at the location since 1975. However it is not uncommon for mailboxes at the intersection to be struck. It is not difficult to understand why Mr. Waite is disturbed about the situation. He is faced with a large volume of traffic on two sides of his home which is located on what appears to be a quiet residential street. The sound of squealing tires is a common one and to parents with small children this is particularly aggravating. As of necessity this study was brief, but it along with the one we did last year indicates that the vast majority of the motorists in the area are operating within the legal posted limits. In my opinion the problem is caused primarily by two factors: 1. The sharp turn in the road. 2. The volume of traffic. Mr. Waite has mentioned a stop sign at the corner, one for the south bound traffic on Lakeshore and one for the east bound traffic on Old County C as a possible solution. While not recommending for or against one, I feel this would certainly be of some help. RS /cp Enclosure: Revised Draft Joint Powers Agreement 0022 JOINT AND COOPERATIVE AGREEIINT "SUBURBAN RAMSEY COUNTY EMERGENCY COMMUNICATIONS BOARD" The parties to this agreement are governmental units of the State of Minnesota. This agreement is made and entered into pursuant to Minnesota Statutes Section 471.59. WITNESSETH: WHEREAS, one centralized emergency communications facility can provide enhanced public safety services and provide the best opportunity for application of current and future communica- tions technology, including technology associated with 911 emergency telephone service, and WHEREAS, the effective utilization of the public safety radio frequency resource in Ramsey County requires continued cooperation in the allocation and sharing of these frequency channels available, and. WHEREAS, police powers are granted to cities and counties in the State of Minnesota by either statute or charter; and WHEREAS, command and control of public safety and emergency service agencies should remain with the chief or director of said agency; and WHEREAS, Minnesota Statutes provide a means for governmental units to exercise jointly those powers which they independently are authorized to exercise; and 0023 -2- WHEREAS, the participant communities in a suburban emergency communication system desire to be represented on a user board for that system; NOW, THEREFORE, BE IT RESOLVED that the communities who are signatories to this agreement hereby commit themselves to joint participation in the development of a suburban integrated emergency communications network that serves as a mechanism for providing citizens with prompt and efficient access to emergency police, fire fighting, emergency medical services, and other emergency services; and BE IT FURTHER RESOLVED that in the event that any Court of competent jurisdiction shall rule contrary to the spirit of this resolution and agreement, the entire agreement shall become null and void. I. GENERAL PURPOSE The general purpose of this agreement is to provide for an organization through which the parties may jointly and cooperatively participate in the development, implementation, operation, and maintenance of an integrated public safety emergency communications system for the Ramsey County suburban area. II. DEFINITION OF TERMS For the purposes of this agreement, the terms defined in this article shall have the meanings given them: 0024 Section 1. "Suburban Ramsey County Emergency Communications Board" means the organization created pursuant to this agreement which is herein referred to as "SRCECB." Section 2. "Board" means the Board of Directors of SRCECB, consisting of one director from each governmental unit which is a member of SRCECB. Section 3. "Member" means any governmental unit which has entered into this agreement and is a party in good standing. Section 4. "Council" means the governing body of the member governmental unit. Section 5. "Governmental Unit" means the County of Ramsey, and any city or town in Ramsey County excluding the City of St. Paul. III. MEMBERSHIP Section 1. Any governmental unit or combination of govern- mental units which has authority to render police, firefighting, or emergency medical services is eligible to be a member of SRCECB. Section 2. A governmental unit desiring to be a member shall execute a copy of this agreement. Section 3. The initial members shall be those members who join SRCECB on or prior to December 31, 1977. Section 4. Governmental units joining SRCECB after December 31, 1977, shall be admitted only upon the favorable vote of two - thirds of the members of the Board. The Board may impose condi- tions upon the admission of members other than the initial members. 0025 -4- IV. BOARD OF DIRECTORS Section 1. The governing body of SRCECB shall be its board. Each member shall be entitled to one director who'shall have one vote. Section 2. Each member shall also be entitled to one alter- nate director who shall be entitled to attend meetings of the board and who may vote in the absence of the member's director. Section 3. Directors and alternate,,directors shall be appointed by the council of each member. In order for SRCECB to be of maximum value to its members, they shall appoint, as their directors and alternates, their chief administrative officers or employees with general administration or public safety management responsibilities. Section 4. If the County appoints the Ramsey County Sheriff as its director, the Sheriff shall be the chairman of the board of SRCECB and shall also be entitled to vote. Section 5. There shall be no voting by proxy; all votes must be cast in person at board meetings by the director or his alternate. Section 6. Directors and alternate directors shall be appointed to serve until their successors are appointed and qualified. Section 7. When the council of a member appoints a director or an alternate director, it shall give notice of such appointment to SRCECB in writing. Such notice shall include the mailing address of the persons so appointed. The names and addresses 0026 -5- shown on such notices may be used, as the official names and address for the purposes of giving any notices required by this agreement or by the bylaws of SRCECB. Section 8. Any director or alternate director shall be subject to removal by the council of the member appointing him, at any time, with or without cause. Section 9. A majority of the voting members shall constitute a quorum of the board. Section 10. A vacancy on the board shall be filled by the council of the member whose position on the board is vacant. V. MEETINGS - OFFICERS Section 1. Any governmental unit desiring to enter into this agreement may do so by the duly authorized execution of a copy of this agreement by its proper officers. Thereupon, the clerk or other corresponding officer of the governmental unit shall file a duly executed copy of this agreement, together with a certified copy of the authorizing resolution or other action, with the county administrator of Ramsey County. The resolution authorizing the execution of the agreement shall also designate the first director and alternate for the member. The agreement shall become effective when it has been executed by four eligible governmental units in Ramsey County, and when executed copies from such governmental units eligible to be members, together with certified copies of the authorizing resolutions, have been duly filed as set out herein. Within 30 days after the effective date of this agreement, the sheriff of Ramsey County shall call the first meeting of the board, which shall be held not later than 15 days thereafter. 0027 -6- Section 2. The sheriff of Ramsey County shall be the Chairman of the Board and shall take office at the first meeting of the Board. ... The Sheriff shall not be entitled to vote except as provided in Article IV, Section 4. Section 3. The vice - chairman of the Board shall be a director elected from among and by the directors representing any of the following municipalities which are members: Arden Hills, Blaine, Falcon Heights, Gem Lake, Lauderdale, Little Canada, Maplewood, Mounds View, New Brighton, North Oaks, North St. Paul, Roseville, Shoreview, Vadnais Heights, White Bear Lake, White Bear Township. The vice - chairman shall be elected in accordance with this section at the first meeting of the board. Thereafter, on the anniversary date of this agreement, the vice - chairman shall be elected from among and by the board of directors. Section 4. A director shall be elected as a secretary- treasurer from among and by the directors representing any member. He shall be elected at the first meeting of the board and a new election shall be held on each anniversary date of this agreement. Section 5. At the organizational meeting, or as soon thereafter as it may reasonably be done, the board shall adopt bylaws governing its procedures, including the time, place, and frequency of its regular meetings. Such bylaws may be amended from time to time, but as a minimum, they shall provide for an annual public meeting of the board to be held each year and, in addition, for regular meetings of the board to be held at least quarterly. 0028 -7- Section 6. Special meetings of the board may be called (a) by the chairman, (b) by the executive committee or (c) by the executive committee upon the written request of a majority of the directors. Five days' written notice of special meetings shall be given to the directors and alternates. Such notice shall include the agenda for the special meetings. VI. POWERS AND DUTIES OF THE BOARD Section 1. Develop a plan and recommend operating procedures for an integrated and coordinated public safety emergency communica- tions system serving the communities in suburban Ramsey County. Section 2. The board shall have full control and management of the affairs of SRCECB including the power to conduct such research and investigation as it deems necessary on any matter relating to or effecting the general purposes of the organization. Section 3. It may delegate authority to the executive committee of the board, between-board meetings. Such delegation of authority shall be by resolution of the board and may be conditioned in such a manner as the board may determine. Section 4. The board shall have no annual budget and shall not expend funds except as duly authorized by the council of each member. No member shall, by virtue of this agreement, be requested to commit, expend, or allocate any funds except as its council shall authorize. Section 5. The board shall have the power to seek financial support from other governmental or granting agencies to accomplish the general purposes of SRCECB. 0029 -8- VII. OFFICERS Section 1. The officers of the board shall consist of the chairman, the vice - chairman, and the secretary- treasurer selected in accordance with the provision of Article V. The vice - chairman and the secretary- treasurer shall be elected at the regular annual meeting of the board. New officers shall take office at the adjournment of the annual meeting of the board at which they are elected. Section 2. A vacancy shall immediately occur in the office of any officer upon his resignation, death, or upon his ceasing to be an employee of his member governmental unit. Upon a vacancy occurring in the office, the executive committee shall fill such position from among directors eligible for the vacant position until the next meeting of the board. Section 3. The three officers shall all be members of the executive coumiittee. Section 4. The chairman shall preside at all meetings of the board and executive committee. The vice - chairman shall act as chairman in the absence of the chairman. Section 5. The secretary- treasurer shall be responsible for keeping a record of all the proceedings of the board and the executive committee. VIII. EXECUTIVE CO1& ITTEF Section 1. The board shall have an executive committee consisting of its three officers and two other directors. The procedure for electing directors shall be the same as for the election of a secretary- treasurer as set forth in Article V, Section 4 of this agreement. 0030 -.9- Section 2. Each member of the executive committee shall have one vote. Section 3. A quorum at a meeting of the executive committee shall require the presence of not less than three (3) executive committee members. Action shall require an affirmative vote of a majority of the full executive committee. Section 4. The executive committee may adopt by -laws governing its own procedures which shall be subject to this agreement, the by -laws of the board, and any resolutions or other directives of the board. Section 5. The executive committee shall meet at the call of the chairman or upon the call of any two other members of the executive committee. The date and place of the meeting shall be fixed by the person or persons calling it. At least forty -eight (48) hours advance written notice of such meeting shall be given to all members of the executive committee by the person or persons calling the meeting. Section 6. The executive committee shall have the following duties: (a) It shall exercise the powers and perform the duties delegated to it by the board of directors, subject to such conditions and limitations as may be imposed by the board. (b) It shall present a full report of its activities at each regular meeting of the board. Section 7. All actions taken by the executive committee shall be subject to control by the board of directors as the board shall deem advisable. 0031 -10- IX. STANDING COMMITTEES There shall be existing under this agreement the Section 1. ointed following three (3) standing committees which shall be app by the board within 90 days of the effective date of this agree- ment: a) Law Enforcement Communications Advisory Committee b) Fire Services Communications Advisory Committee c) Emergency Medical Services Communications Advisory Committee Section2. The membership of each standing committee shall consist of one member from each law enforcement, firefighting, and emergency medical services agency, respectively, providing emergency services in any part of suburban Ramsey County. Section 3. The memebers of each standing committee shall elect their own chairman. The duly elected chairman of each standing committee shall serve, without vote, on the board of SRCECB. IX. ASSOCIATES Section I. It is recognized that certain governmental units do not qualify for membership or which choose not to be members may desire to follow and participate in the activities of SRCECB as a form for input into system design and other characteristics which may be valuable in maintaining a complete coordinated public safety emergency communication system. Such governmental units may affiliate with SRCECB as "associates." Section 2. A governmental unit desiring to become an associate may do so in the same manner as is required to become a member, except as otherwise provided in this article. 0 0 3 2 Section 3. At the time of applying for "associate status" the governmental unit making the request may indicate in writing that it is not joining as a member, but rather as an associate. Section 4. An associate may appoint a director and an alternate director to the board, but such director (or alternate) shall be without voting power, and he shall not be eligible to serve as an officer, nor shall he be counted for quorum purposes. Section 5. An associate may discontinue its relationship with SRCECB at any time by giving written notice of withdrawal to the secretary- treasurer of SRCECB. X. I wish to withdraw that request, as I have realized it would not be in the best interests of the community to close off Park Street. Apparently there is no other proposed street from Demont through to B -2, and the vacating of Park Street would deprive some students of a safe My request to have Park concern over past, present, with the existing condition Terrace Heights Trailer park route to school.
