ORDINANCE NO. <br />133 <br />AN ORDINANCE AMENDING THE LITTLE CANADA <br />CODE SECTION 1701.070 SUBD. 4, TO PROVIDE <br />FOR THE DEFERMENT FOR SENIOR CITIZENS <br />AND DISABLED PERSONS OF ASSESSMENTS FOR THE <br />COST OF REMOVAL BY THE CITY OF DISEASED <br />SHADE TREES. <br />THE COUNCIL OF THE CITY OF LITTLE CANADA DOES HEREBY ORDAIN AS FOLLOWS: <br />Section 1. <br />That the Municipal Code of Little Canada, Section 1701.070, subd. 4, <br />is hereby amended to read as follows: <br />"Subd. 4. On or before September 1 of each year the clerk shall list the <br />total unpaid charges for each abatement against each separate lot or parcel to <br />which they are attributable under this ordinance. The council may then spread <br />the charges or any portion thereof against the property involved as a special <br />assessment under Minnesota Statutes Sec. 429.101 and other pertinent statutes <br />for certification to the county auditor and collection the following year along <br />with current taxes. An exception from this requirement shall be made in the case <br />of senior citizens and disabled persons. In the case of senior citizens and <br />disabled persons, such assessments shall be deferred except in those cases where <br />the property owner requests that the deferment not apply. For the purpose of <br />this sub - section, a senior citizen is defined as a person 62 years of age or <br />older, the owner and head of a household, who is entitled to benefits under the <br />social security act or other similar act or plan. For the purpose of this <br />sub- section, a disabled person is defined as one who is so disabled as to qualify <br />for disability insurance benefits under the social security act or some similar <br />act or plan, and is also the owner and head of his or her household." <br />Section 2. <br />This ordinance shall take effect and be in force from and after its <br />passage and publication. <br />Passed by the Council of the City <br />of Little Canada, this _ day <br />of , 1977. <br />Ayes -- <br />Attest: Nays -- <br />Clerk <br />18 <br />MAYOR <br />
