(Applicable to Mudslide -Prone Areas) Resolution Number <br />B•II <br />SAMPLE RESOLUTION TO BE USED TO INDICATE THE BUILDING PERMIT SYSTEM <br />WHICH THE COMMUNITY HAS ADOPTED AND THE <br />REVIEW PROCEDURE FOR THAT SYSTEM <br />WHEREAS, the (NAME OF COMMUNITY) has adopted and is enforcing (CITE BUILDING CODE, <br />ZONING ORDINANCE), and <br />WHEREAS. Section <br />of the aforesaid prohibits any person, firm, or corporation from erecting': constructing, enlarging, altering, <br />repairing, improving, moving or demolishing any building or structure without first obtaining a separate <br />building permit for each building or structure from the (TITLE OF OFFICIAL), and <br />WHEREAS, the (TITLE OF OFFICIAL, OFFICE OR AGENCY) must examine all plans and <br />specifications for the proposed construction when application is made to him for a building permit. <br />NOW, THEREFORE, BE IT RESOLVED by the (NAME OF LOCAL LEGISLATIVE BODY) of <br />(NAME OF COMMUNITY) asiollows: <br />1. That the (TITLE OF OFFICIAL, OFFICE OR AGENCY) shall require the issuance of a permit <br />for any excavation, grading, fill, or construction in the community; and <br />2. That the (TITLE OF OFFICIAL, OFFICE OR AGENCY) shall require review of each permit <br />application to determine whether the proposed site and improvements will be reasonably safe from <br />mudslides. If a proposed site and improvements are in a location that may have mudslide hazards, a <br />further review must be made by persons qualified in geology and soils engineering; and the proposed new <br />construction, substantial improvement, or grading must (i) be adequately protected against mudslide <br />damage and (ii) not aggravate the existing hazard. <br />Date Passed <br />HUD-1650.14-73) <br />027 <br />Certification <br />1 <br />
