The lot at 2045 Labore Road lies west of the existing easement and does have sufficient <br />back yard area for a single additional lot. However, granting the additional 17 feet of <br />right -of -way would result in the existing house being noncompliant with the City's <br />setback requirements. In addition, the construction of the Improvements necessary to <br />create and serve the lot from Labore Road is estimated at more than the value of the lot. <br />The most viable option for providing some development potential for this lot would be to <br />combine a portion of the back lot with the Pinetree Pond development to allow for an <br />additional lot in the proposed development. This option has been dismissed with the <br />property owners and they have not shown Interest In pursuing this option. <br />The purpose of the existing 33-foot road easement was to provide for public <br />improvement access to the area north of Labore Road including the proposed Pinetree <br />Pond area. It has always required the cooperation of several property owners to be <br />utilized for development potential and has not been used for any City improvements to <br />date. It is our opinion that that public improvement access, while along a different <br />alignment, would be provided to the area by the Pinetree Pond plat and that the existing <br />33 -foot road easement could be vacated conditioned on the Pinetree Pond plat.
