5. The Brausen's have proposed a plat alternative, see Page 11, which would resolve their <br />access issue. This proposal does not require use of the existing 33 foot easement. <br />However, this proposal is not acceptable to the developer of Pine Tree Pond and would <br />result in a Plat, Pine Tree Pond, which is not nearly as attractive as the presently proposed <br />Plat for Pine Tree Pond. In addition, Acosta and Boog would not be allowed to develop <br />their properties independently; rather they would have to develop their properties in <br />conjunction with each other and Brausen. The Brausen option exists solely to benefit the <br />Brausen's at the cost of Acosta, Boog and Masterpiece Homes. <br />Mrs. Bilek stated that Masterpiece Homes agreed to maintain the trees on the property located at <br />2945 Labore Road. It should be pointed out that the Purchase Agreement only calls for <br />Masterpiece to place pine trees between the new home and the Acosta home. It also states that <br />the buyers intend to save the pine trees located within the 33 foot easement. This does not create <br />an obligation on the part of Masterpiece to maintain all the trees presently located on the 2945 <br />Lahore Road parcel. <br />2 <br />5 <br />
