5. The Brausen's have proposed a plat alternative, see Page 11, which would resolve their
access issue. This proposal does not require use of the existing 33 foot easement.
However, this proposal is not acceptable to the developer of Pine Tree Pond and would
result in a Plat, Pine Tree Pond, which is not nearly as attractive as the presently proposed
Plat for Pine Tree Pond. In addition, Acosta and Boog would not be allowed to develop
their properties independently; rather they would have to develop their properties in
conjunction with each other and Brausen. The Brausen option exists solely to benefit the
Brausen's at the cost of Acosta, Boog and Masterpiece Homes.
Mrs. Bilek stated that Masterpiece Homes agreed to maintain the trees on the property located at
2945 Labore Road. It should be pointed out that the Purchase Agreement only calls for
Masterpiece to place pine trees between the new home and the Acosta home. It also states that
the buyers intend to save the pine trees located within the 33 foot easement. This does not create
an obligation on the part of Masterpiece to maintain all the trees presently located on the 2945
Lahore Road parcel.
2
5
