Carley & Associates <br />500 West Highway 96 <br />St. Paul, MN 55112 <br />Re: Little Canada Water Improvement <br />Dear Mr. Besse: <br />We have received your note dated August 16, 1978 and take issuance with a <br />number of the items listed and your statement that pipe laying operation must <br />cease until these items are corrected. As I have stated to you previously, the <br />fence on Boss Road was never disturbed by our construction as our pre - construction <br />pictures will indicate. We also discussed with you previously the condition of the <br />culvert on 2805 Country Drive. We will be happy to proceed with replacement of <br />these items but feel,that extra compensation should be due us. <br />In addition to the above, we have encountered other problem areas. They are <br />as follows: <br />1. Deficiency of suitable dirt for backfill. We have received a change <br />order from you for removing unsuitable dirt on the County Roads and <br />replacement of this material with granular. We have stated to you <br />previously that this same procedure should have been used on the city <br />portion of Labore Road. Now after your decision to use the natural <br />dirt, you have asked us to re- excavate certain soft spots and re -pave <br />them. Compensation should be due us for this item. <br />2. Delay in obtaining easements. Your specifications state that all <br />easements will be obtained by June 1, 1978. However, last week we <br />were shut down three days on the Southern Slopes Addition because <br />a permit had not been obtained from the Metropolitan Sewer Board and <br />an easement had not been obtained from a property owner. <br />3. Delay in Survey Crew staking. We have requested stakes from you twice <br />. this week for the water and street sub -grade on Burke Lane. It is our <br />understanding that you will not give us these stakes until we have what <br />you consider the proper equipment to sub -grade this area. We feel that <br />the method we choose to sut -grade this area is of our concern and that <br />your request for a scraper is unjustified. <br />W.2 feel we are justified in recovering any additional costs which are a result <br />of the above mentioned items. <br />- Page 1 - <br />9 0 <br />
