Little Canada Planning Commission <br />25 May 1978 Page Three <br />The sketch submitted by the applicant, a copy of which is attached, indicates a 40 foot <br />front yard setback and a 5 foot side yard setback. While the front yard setback is in <br />compliance with the Zoning Ordinance, the side yard setback cannot be less than 15 <br />feet. This, however, does not appear to be a problem. <br />RECOMMENDATIONS <br />While not wishing to prohibit improvement of undesirable conditions, namely storage of <br />junk cars and car parts, it k felt that efforts should be made at this time to bring the <br />entire property closer to compliance with the existing Municipal Code. <br />It is recommended that a special use permit for a Planned Unit Development be granted <br />and a building permit issued contingent upon the following: <br />1. The existing driveway to the repair shop be used only for maneuvering cars into <br />the shop, and that the curb cut be narrowed to the 24 foot requirement. Cars <br />are not to be parked in front of the repair shop. At such time as the trees between <br />the two existing driveways become diseased or are removed, the driveway to the <br />shop should be closed and only one access be provided to the property from South <br />Owasso Boulevard. <br />2. Adequate parking for both the existing repair shop and the proposed building be <br />provided at the rear of the shop as per zoning ordinance requirements. This would <br />amount to at least 6 spaces. <br />3. Following completion of the proposed building, no junk cars will be allowed to <br />be stored outside of the building. <br />4. The property should be cleaned up,and scattered auto parts should be stored inside <br />the building. In the future, the property should be maintained as per City Code <br />requirements. <br />5. The existing residence, constituting a nonconforming use is not to be altered or <br />expanded structurally. In the event of destruction by fire, the dwelling should not <br />be replaced. <br />6. A bond should be secured by the City to ensure compliance with improvements required <br />for this special use permit. <br />7.
