December 6, 1978 <br />Mr. Larry Squires, Building Official <br />Municipal Offices <br />515 Little Canada Road <br />Little Canada, Minnesota 55117 <br />RE: Shopping Center - Lakeshore Avenue <br />Dear Mr. Squires: <br />In addressing Dr. Holmes request for a clinic to be constructed on Little Canada <br />Road west of Lakeshore, we have encountered what appears to be an ordinance <br />violation on the part of the shopping center. The center has a six foot fence which <br />extends past the front building line to the front property line. While the zoning <br />ordinance is silent relative to fencing in business districts, it would appear that <br />based upon the definition of yard (902.02.0.70) and front yard (902.020.71) that the <br />fence extension into the front yard is a violation of the ordinance. <br />The reason this matter is brought to your attention is that the fence has created some <br />concern relative to the Holmes development proposal. Due to limited visability and <br />the obstruction created by the fence, Dr. Holmes requested that a ten foot front yard <br />variance for a thirty foot setback be granted. We are recommending against this <br />request, but believe that through resiting of the building, that the problem is <br />basically resolved. The situation would, however, apparently be improved through <br />correction of the shopping center fence being brought into ordinance compliance. <br />This matter should apparently be reviewed in greater detail.
