PAUL 55101 <br />612` 296 -6159 <br />STATE OF MINNESOTA <br />DEPARTMENT OF PUBLIC SAFETY <br />SAINT PAUL 55155 <br />REQUIREMENTS FOR WINE "ON SALE" LICENSES <br />CHAPTER 345, MINNESOTA SESSION LAWS, provides that Wine "On Sale" Licenses be <br />approved by the Liquor Control Director. Wine "on sale" licenses may be issued to <br />restaurants with a minimum seating capacity of 25 persons. Wine up to and including <br />14% alcohol by volume may be served by bottle, glass or carafe, but may be consumed <br />only in the licensed establishment. <br />Wine license fees are set by the issuing city or county authority but shall not <br />exceed one -half of the fee charged for an on -sale liquor license or $2,000, whichever <br />is lower. The fee may be less. Wine licenses may not be issued by a County Board if <br />licensee already has been issued a liquor license by the county board or a municipality <br />within the county; this is pursuant to Chapter 334, 1975 Session Laws. The same <br />restriction does not apply to cities. <br />Chapter 345 states in part "meals are regularly served to tables to the general <br />public" therefore, wine licenses will not be approved for private clubs. Wine licenses <br />may be issued by county boards, municipalities authorized to issue on -sale liquor licenses <br />and municipalities with municipal liquor stores. <br />The hours of sale are the same as for liquor, 8:00 A.M. to 1:00 A.M. Monday through <br />Saturday; 12 noon to 12 midnight on Sunday. The license authorizes the sale of wine for <br />7 days a week unless there is a restriction by the governing body for the Sunday sale <br />of wine. <br />It is required that the following fully executed forms be submitted prior to <br />approval: <br />(1) Form DPS 914 -5 -75 - application (in duplicate copy) <br />(2) Form DPS 9116 (5 -75) - bond (in duplicate copy) <br />(3) Form DPS 9115 (5 -75) license certificate <br />(4) Form 84 - Retailer's Identification Card application (This is to be submitted <br />with the $5.00 fee and is issued on a calendar year basis, expiring Dec. 31 of <br />each year. Such card authorizes shipments of wine from the wholesalers.) <br />The above listed forms are supplied by the Liquor Control Division. <br />The bond shall be in the penal sum of not less than $3,000 nor more than $5,000. <br />The amount is to be determined by the local governing body. Such bond shall cover the <br />exact dates of the license period, and it is also suggested that special attention be <br />given to completion of the reverse side of the bond by affixing signature of representative` - <br />of council. <br />A certified copy of the articles of incorporation and by laws are required for a <br />new license and also an inspection of the premises will be made by an agent of the <br />Liquor Control Division before approval can be granted. <br />4 <br />AN EQUAL OPPORTUNITY EMPLOYER <br />
