MINUTES <br />CITY COUNCIL <br />FEBRUARY 8, 2006 <br />The City Planner indicated that the proposed text amendment would <br />shrink the front yard setback for the Shoreland District from 50 feet to 30 <br />feet which is the required front yard setback in the underlying R-1 District. <br />The Planner noted that many of the existing houses in the Shoreland <br />District have 30 foot front yard setbacks. This text amendment will <br />eliminate the conflict between the Shoreland DistricC and the R-1 District. <br />Allan reported that she contacted the DNR to determine the genesis of 50 <br />foot front yard setback that is recommended for Shoreland Districts. In <br />discussing this with a hydrologist at the DNR, he was unsure as to why <br />that recommendation came about, and offered to discuss the issue further <br />with other members of the DNR to try to come up with an answer. Allan <br />suggested that the matter be tabled for two weeks pending an answer from <br />the DNR. <br />Keis pointed out that there are many homes in Che Shoreland District that <br />have Che 30 foot setback rather than the required 50 feeC. Allan noted that <br />these homes would be considered non-conforming uses. Allan also <br />reported that the DNR informed her that when the City proposes a change <br />to the Shoreland Ordinance, the City should be notifying State and County <br />officials of the proposed change. <br />The City Planner noted that the City could pass the proposed Text <br />Amendment subject to review by the State and County. The Planner <br />indicated that the front yard setback regulation is commonly much less <br />than the 50 feet in the Shoreland ordinance model; therefore, he did not <br />think the DNR was routinely worried about changes of this nature. The <br />Planner stated that the general intent is to protect the area adjacent to a <br />waterway; therefore, moving a structure further from the road and closer <br />to the lake appeared to be counterproductive. <br />Allan noted Chat Che 50 foot front yard setback is in place for the Shoreland <br />District and it seems Co be working. She noted that the increased setback <br />provides for larger front yards and more buffer between streets and <br />waterways as a proCection from pollutants washing off streets. Allan <br />stated Chat she did not want Co act on the proposed Text Amendment until <br />the DNR has had a chance to look further into the issue. <br />The Council agreed that there was no problem in tabling action on this <br />matter for two weeks. <br />Mr. LaValle introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2006-2-26 -TABLING ACTION ON THE <br />PROPOSED TEXT AMENDMENT TO THE SHORELAND <br />DISTRICT DECREASING THE REQUIRED FRONT YARD <br />
