MINUTES <br />CITY COUNCIL <br />FEBRUARY 8, 2006 <br />Galba stated that they never anticipated that the sports courC would be such <br />an issue. She noted the pine trees to the south of the court on the adjacent <br />property, and suggested that the landscaping they will install will <br />eventually provide a similar screening effect. <br />Blesener noted that if Che City approves the TexC Amendment before it this <br />evening, the right to have a recreational use in a front yard will be <br />afforded any residential property in the City that could maintain the proper <br />setback. <br />Stephanie Galba pointed out that they have a large front yard. Blesener <br />noted that there are many properties in the City with large front yards. <br />Keis asked if the Galba's had given any thought to putting the sports court <br />in the back yard. Matt Galba reported that when people live on the lake, <br />they consider their lakeside as their front yard. Galba indicated that, <br />therefore, they consider the lakeside as their front yard and the Edgerton <br />Street side as their back yard. Keis asked if the Galba's did not want to <br />put the sports court in what they consider to be their front yard because it <br />would be more visible to them. Galba replied that they use the lakeside <br />portion of their property and did not have a use for the Edgerton Street <br />side. Galba stated Chat he is willing to do whatever the City asks of him to <br />make the sports court look good and be acceptable on the Edgerton Street <br />side of his house. Galba felt that with the proper landscaping the sports <br />court will not be visible. Galba pointed out that he took an old house <br />down on this side of the property and made the area look better. He <br />expressed concern about his ability to use this portion of his yard. Galba <br />noted that the sports court is for the use of his children and neighborhood <br />children. <br />LaValle asked why the Galba's did not consider the fact that a permit <br />would be needed for this type of structure. Matt Galba stated that he did <br />not think a permit would be needed. Allan pointed out that Galba is in the <br />construction trades, therefore, should have considered the possibility that a <br />permit would be needed. <br />Stephanie Galba reported that they reviewed the City Code which does not <br />say a property owner cannot have a sports court. Galba indicated that her <br />husband asked inspectors from other cities who indicated that a permit <br />would not be necessary. Therefore, they thought the sports court would be <br />no big deal. Galba pointed out that sports courts are becoming very <br />popular, and she did not feel the court would devalue properties in the <br />area. <br />LaValle felt the sports court did impact properties in the area, pointing out <br />the need for screening as well as the lighting of the court during evening <br />7 <br />
