Oca <br />Gentlemen= <br />We have been retained by Dr. Murray Tanasichuk, the owner <br />of the Sleepy Hollow Apartments, 180 -210 County Road B.2, Little • <br />Canada, Minnesota, for the purpose of pursuing his claim for <br />damages against the Village of Little Canada for its failure to . <br />provide proper drainage for surface waters flowing into a pond <br />directly to the south of the aforementioned apartment buildings. <br />As early as June 10, 1973, shortly after his purchase of the <br />property, Dr. Tanasichuk notified the City Clerk of the existence <br />of a serious drainage problem in this area. Discussions betwe`n,rn <br />Dr. Tanasichuk and eph1Clebeckk,,eCouncilman DeBais and Clayton Parks) <br />were (including Joseph ;; which <br />were held during the next two years concerning the means y <br />the City could discharge its obligation to avert the thre.ir of <br />flooding in the area. An engineering study of the problem was <br />commissioned by the Little Canada City Council in 1973, •Ind a sur- <br />vey was subsequently performed by Milner W.
