MINUTES <br />CITY COUNCIL <br />FEBRUARY 22, 2006 <br />neighboring properties would suffer a diminution in property <br />values due to the highly exposed location of the facility adjacent <br />to the public street. <br />6. The applicant has not suffered any infringement in the rights to <br />put his property to reasonable use, since these uses are legal in <br />the rear yard under the City's zoning regulations, subject to <br />requirements for setbacks, lot coverage, proper permitting, and <br />other applicable building and zoning code requirements. <br />7. The proposed facility is inconsistent with the architectural <br />character of the front yards of surrounding property. <br />8. The applicant has failed to demonstrate that the requested zoning <br />ordinance amendment has met the standards required by <br />paragraphs l.a., I.b., I.c., and I.d. cited above. <br />The foregoing resolution was duly seconded by Blesener. <br />Ayes (4) LaValle, Blesener, Keis, Allan. <br />Nays (1) Montour. Resolution declared adopted. <br />The City Planner noted that given the Text Amendment was denied, the <br />Conditional Use Permit process for recreational use in a front yard does <br />not exist. <br />TRANSFER Linda Yeng, representing Ye Ge Lor, potential new owner of My Le Hoa <br />OF Chinese Restaurant, appeared before the Council requesting approval of <br />LIQUOR the transfer of On-Sale Wine, On-Sale 3.2 Intoxicating Malt Liquor, <br />LICENSES - Consumption & Display, as well as issuance of Sunday Liquor, 2 a.m. <br />MY LE HOA Liquor, and Entertainment License. <br />cxINESE <br />RESTAURANT Blesener asked My Le Hoa's current hours. Sam Nguyen reported that <br /> they are typically open from 11:30 a.m. to 9 p.m. On the occasions that <br /> they have a banquet, they are open until Midnight. Yeng reported that <br /> they would like to add some entertainment, such as a band or karaoke, <br /> thus are requesting the Entertainment License. When the entertainment is <br /> in place, they would like the option of staying open until 2 a.m. <br />LaValle noted that typically with new owners/operators, the City has put a <br />six-month review in place on a license. The City Administrator noted that <br />liquor licenses some up for renewal on July 1st. Therefore, another review <br />would occur within the next few months. <br />
