I am in receipt of your letter of March 26, 1975 transmitting invoices for certain matters concerning correction of assess- ments for Rauenhorst property in Little Canada. In that the assessment errors were the responsibility of the City Engineer, Don Carley, I must respectfully submit that Rauenhorst is not responsible for professional services to the City of Little Canada in correcting the errors. Upon receipt of the incorrect assessment, Rauenhorst Corporation duly and properly notified the City Engineer and indicated that the method of assessments was unfair and also indicated to the City Engineer that even if such assessment was not found to be unfair that there were errors in the front footage calculations. These errors in front footage calculations were rectified in the recent proceedings and arose out of errors in calculations made by the City Engineer. I do not believe that such errors and their rectification should be the responsibility of Rauenhorst Corporation. Further, Mr. Don Carley indicated to Rauenhorst Corporation that he would correct the "unfair" part of the assess- ment, namely that the assessment would be on an area basis rather than a front footage basis. Mr. Don Carley was inclined to keep silent at the assessment hearing and did not proceed as he had promised to Rauenhorst. For the above reasons I do not believe that Rauenhorst has responsibility for payment of the invoices which you included with your March 26, 1975 letter. VexT trmlz your amew L. Tucker, Asst. Secy.
