MINUTES <br />CITY COUNCIL <br />APRIL 10, 2013 <br />compromise has not been reached. The Administrator also noted that one <br />of the property owners has indicated they are not willing to grant the <br />additional 17 feet of road easement even if the 33 -foot easement remains. <br />The Administrator noted that the Brausen's would like to see development <br />of their property occur under the bulb plan that they proposed. While this <br />plan appears to meet City Code requirements, the Pinetree Pond developer <br />has indicated that he is not comfortable with this plan from a marketing <br />standpoint. <br />The Administrator stated that there has been talk about the City running <br />over property owners in this process. He noted that the City has tried to be <br />respectful of the various diverse interests and accommodate those interests <br />where possible. Examples are: <br />o The developer was required to prepare a ghost plat to show <br />how development could occur for the northeast properties; <br />o Brausen development concepts were reviewed; <br />o The developer has been asked to reduce the utilization of <br />the easement, if vacated, from 33 feet to 8 feet along the <br />three properties to the northeast. That 25 feet would be <br />dedicated to the City as an outlot and could be used to <br />offset the 50 feet of road easement that would be needed to <br />bring a road into the Acosta /Boog /Brausen properties for <br />development. <br />o The City offered to purchase the back portion of the <br />Brausen property and obtain options to purchase on the <br />Acosta and Boog properties. The City could not reach <br />agreement on price with the Brausen's. <br />The Administrator indicated that no parcel of land will be landlocked as a <br />result of the vacation. All existing parcels abutting the current easement <br />have access to LaBore Road. No lots of record are being landlocked. <br />The Administrator reported that the vacation is a legislative decision for <br />the City Council. The courts allow the Council a lot of discretion in <br />making this decision. The City could vacate the entire 33 feet of road <br />easement which would then accrue to 2966 Arcade Street owned by the <br />developer. However, the City asked the developer to dedicate the 25 feet <br />of easement mentioned earlier as an outlot to the City to provide an offset <br />of road easement that will be needed when the northeast property <br />develops. The Administrator stated that the City realizes that this doesn't <br />accommodate everyone's desires, however. <br />The City Administrator reported that development potential for the Bilek <br />property was reviewed. He noted that utilizing the 33 foot easement, plus <br />an additional 17 feet from the Bilek property to bring a road in to serve <br />6 <br />
