MINUTES <br />PLANNING COMMISSION <br />APRIL 11, 2013 <br />increase lot count in a subdivision." The Planner stated that there is some <br />concern that the restriction for using this clause may be overly limiting <br />and a broader exception should be considered. The Planner indicated that, <br />if the Commission agrees, he would bring a proposed ordinance <br />amendment to the Commission for consideration at their next meeting. <br />The Commission was in agreement with that course of action. <br />ROAD The City Planner noted that the Commission heard comments made this <br />LOCATIONS evening that the City has the right to put roads wherever it wants. The <br />Planner indicated that that is not correct. He noted that typically road <br />locations are proposed as part of a development proposal, and are <br />dedicated to the City by a developer. The development process is a <br />negotiated process between the developer and the City. If the City <br />initiates an action to put in a road, the City must acquire that property <br />through the eminent domain process for the reasons of public purpose. <br />Otherwise, an action of this nature on the part of the City would be <br />considered a taking. <br />ADJOURN <br />Duray recommended that the meeting be adjourned. <br />Motion seconded by Baraclough. <br />Motion carried 7 — 0. <br />There being no further business, the meeting was adjourned at 9:10 p.m. <br />Respectfully submitted, <br />1 <br />Kathy Glanz <br />City Clerk <br />- 12 - <br />
