BOARD OF WATER COMMISSIONERS ELEVENTH RIDER TO AGREEMENT THIS AGREEMENT, Made this day of , 1979, by and between the BOARD OF WATER COMMISSIONERS OF THE CITY OF SAINT PAUL, hereinafter called the Board, and the CITY OF LITTLE CANADA, County of Ramsey, Minnesota, hereinafter called the City, being the Eleventh Rider to that certain Agreement made by and between said Board and said City the 13th day of July, 1966, and by this reference incorporated herein and made part hereof with the same intent, purpose and effect as if said Agree - anent were set forth herein, verbatim. WITNESSETH: WHEREAS, The Board is fee owner of a 185 foot wide right -of -way across the South One -Half (SZ) of the Southwest One- Quarter (SA) of the Northwest One- Quarter (NWT) of Section Eight (8), Township 29 North, Range 22 West, County of Ramsey; and WHEREAS, The City desires permission to enter upon certain portions of said Premises and to therein, thereon and thereunder install, and operate a six -inch (6 ") water main; an d WHEREAS, The Board is willing to grant said permission to the City consistent with the requirements and safety of the works of the Board, NOW, THEREFORE, BE IT AGREED, In consideration of the mutual promises and agree- ments of the parties hereto, that: 1. Said Board hereby grants to said City the permission to install and operate a six -inch (6 ") water main across the Board's right -of -way, as outlined in red color and location as shown on attached drawing marked Exhibit "A ". 2. A minimum clearance of 1.0 foot must be maintained between the bottom of the six -inch (6 ") water main and the top of the ninety -inch (90 ") conduits. 3. That Paragraph 42 of the original Agreement dated 13 day of July, 1966, pertaining to "Minimum Standards for Public Waterworks and Public Sewers" be rescinded for this project and that the six -inch (6 ") water main and 041
