If a town or a city entirely within one county has a 1980/1981 levy limit base per <br />capita in column 7 which is below 85% of the average 1980/1981 levy limit base per <br />capita of its county, shown in colum 9, application may he made to the Levy Limitations <br />Review Board to have its 1980/1981 levy limit base adjusted by an amount sufficient <br />to increase the town or city's 1980/1981 levy limit base per capita to 85% of the average. <br />If a joint city has a 1980/1981 levy limit base per capita in column 7 which is below <br />85€ of the average 1980/1981 levy limit base per capita of one or more of the counties <br />containing it, shown in column 9, application may be made to the Levy Limitations <br />Review Board to have the city's 1980/1981 levy limit base adjusted. For each county <br />where the city's 1980/1981 levy limit base per capita is below 85% of the average, the <br />difference between 85% of the average and the city's 1980/1981 levy limit base per <br />capita would be multiplied by the portion of the population of the city in that county; <br />and this amount would be added to the 1980/1981 base. <br />To apply for a 1980/1981 levy limit base adjustment under Minnesota Statutes, Section <br />275.52, Subdivision 4(d) from the Levy Limitations Review Board, address a letter <br />requesting the adjustment to me. Ordinarily, a town or a city requests that the levy <br />limit base adjustment be the largest amount possible, since once it has received a <br />base adjustment under Minnesota Statutes, Section 275.52, Subdivision 4(d), it cannot <br />apply for another base adjustment under any of the clauses of Subdivision 4. However, <br />if a city or town received an adjustment to 80% of the county average levy limit base <br />per capita prior to June 1, 1979, and its 1980/1981 levy limit base per capita is <br />below 85% of the county average, it may still avail itself of this one time opportunity <br />to increase its levy limit base per capita to 85% of the county average. <br />To assist this Division in scheduling meetings of the Levy Limitations Review Board <br />and in calculating the 8% levy limitations, the application for a levy limit base <br />adjustment should be received by the Department of Revenue prior to August 1, 1980. <br />The members of the Levy Limitations Review Board are the Commissioneroof Revenue, <br />the Chairman of the Minnesota Municipal Board, and a public member appointed by the <br />Governor.
