CHURCH OF THE ANNUNCIATION <br />HAZELWOOD <br />R 3 NORTHFIELD, MINNESOTA 55057 <br />April 28,1980 <br />To Whom it may concern: <br />About in the middle 1940's as we were plan- <br />nin; to build a parish School a -tat St John's Church of :ittle Canada <br />The Board of Trustees of the parish consisting ofmgyself,Rev.Arthur <br />H. Durand and Mr Henry Tessier Sr and Attorney Fredrick P. Hemmer <br />requested the Highway Department to eleminate the section of the road <br />that passed through the church property just south of the church con- <br />necting NcMenemy Road with Little Canada Road to the west and to build <br />a new connection in such a way that Little Canada Road wouldpass north <br />od the church ,through the church property but in a more straight and <br />continous manner eastward toward Edgerton Street. <br />This was very agreeable to the Highway Depat£rtment, and they proceed- <br />ed to survey the right of way. However a serious problem remained so <br />that in order to maintain the required width of Little Canada Road at. <br />the West End of the church property it would be necessary to acquire <br />a considerable tryangle shape of property from the front of the Bert <br />Kruse property fronting on Little Canada Road. <br />The Church Board of Trurtees then entered into a further agre- <br />ement with Bert Kruse that on condition that he would turn over to the <br />Highway Department the wedge of land that needed from his frontage,the <br />Church in turn wou�d teed to Bert Kruse a similar strip of land a!jac- <br />ent to the east bolidary of his property from land we owned north of the <br />proposed Little Canada Road. <br />This arrangement was agreeable to all parties concerned and <br />Mr Hemmer who was a layyer was asked to draw up the agreement and was <br />furnished with the property discription of the strip the County would <br />require from the Bert Kruse property, as well as a disceiption of the <br />strip Bert Kruse whuld acquire from the church property along the east <br />line of his lot. <br />In due time all these changes were made,Iittle Canada Road <br />was builtas planned and the new property line established between the <br />Bert Kruse property and along his east line and the west line of the <br />church property.The required legal papers were dram up by Fredrick <br />P /Hemmer and duly signed be all parties concerned. <br />I understand that now those papetd and agreements should <br />have been filed when this transaction was completedsby Mr Hemmer and <br />I was understanding that all was completed as required, and I was con- <br />vinced that Mr Hemmer had completed his part as Attorney for he never <br />told me there was any reason why he should not do this.It is true,as I <br />remember that he did not put in a bill for his services, but I am sure <br />that this was not the reason for not having filed the transaction,and <br />I must be3ieve rather that he had the intention to do so but neglected <br />it to the point where he may have forgot about it ,and the papers may <br />well still be in his files. <br />There is nodoubt about the transaction which I have described <br />and I am ready to make these statement above under oath,if this will <br />help to clear up this matter. <br />Sigend this 29th day of April,.980 <br />Msgr Arthur H.
