NORTHWEST ASSOCIATED CONSULTANTS INC. <br />MEMORANDUM <br />TO: Little Canada Planning Commission, <br />Mayor and City Council <br />FROM: Brad Nielsen <br />DATE: 4 November 1980 <br />RE: Ryan, Dennis - Garage Variance Request <br />FILE NO: 758.09 - 80.21 <br />BACKGROUND <br />Mr. Dennis Ryan, owner of Lot 4, Block 3, Lake Gervais Penninsula has requested a <br />building permit to construct a garage on the east side of his existing home. As pro- <br />posed, the garage will require a 14 foot variance to the City's zoning requirements. <br />The property location and a sketch of the site are illustrated in the attached exhibits. <br />ANALYSIS <br />The property in question is a corner lot fronting on Carla Lane South and Keller Parkway. <br />Corner lots in the R -1 District require a setback of 30 feet from public street rights -of -way. <br />The applicant's house is situated such that the proposed garage will encroach 14 feet into <br />the required setback on Keller Parkway. In addition, the Zoning Ordinance prohibits <br />driveway curb cuts from being closer to the intersection of street rights -of -way than <br />40 feet (Section 903.040 D.8.E.). Consequently, unless the driveway is curved sharply <br />to the west, a second variance must be requested (see Exhibit B attached). <br />The applicant has cited a variance granted across the street on Lot 2, Block 4 (see <br />Exhibit A attached) in which the house was allowed to encroach on the Keller Parkway <br />setback. It is assumed, however, that the variance was granted due to the narrow <br />width of that lot, and that the variance only allowed reasonable use of that property. <br />In terms of the property in question, there is more than enough room to locate the <br />garage on the west side of the house without requiring a variance to setbacks or a <br />curb cut variance.
