1 <br />PLANNING REPORT <br />orthwest Essociated consult2nts, inc. <br />T0: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: 12 November 1986 <br />RE: Cellular One Conditional Use Permit <br />FILE NO: 758.09 - 86.36 <br />BACKGROUND <br />Mr. Philip Oxley has applied for a conditional use permit on behalf of Cellular <br />One. The purpose of the CUP is to allow the construction of transmitting facilities <br />on property located at 53 South Owasso Boulevard. The site is zoned I -1, Light <br />Industrial, and is a portion of the Donovan Construction Company property. <br />ANALYSIS <br />Cellular One is a mobile telephone company which is regulated by the FCC and the <br />Minnesota Public Utilities Commission. Concurrent with this CUP application is a <br />text amendment allowing facilities such as these as conditional uses. The criteria <br />for conditional use evaluation are listed in the text amendment analysis. The site <br />is located within an industrially zoned area and complies with the CUP intent. <br />One problem has become apparent with the submission of the site plan. The site has <br />no street frontage and the addition of the telephone facility would constitute a <br />second principal use. This may require the use of a Planned Unit Development or <br />possibly a subdivision. The lack of street frontage, however, brings up another <br />issue. In 1984, the City Council required that the property owners in this area <br />dedicate and improve, at least with a gravel surface, a road along the railroad <br />to provide emergency vehicle access to the properties which would be isolated during <br />the periods when a train is using the track. In addition, the Council required <br />that the road be improved to City standards, including paving, curb and gutter <br />prior to any building being allowed in the area.
