TO: Little Canada Planning Commission FROM: Stephen Grittman DATE: 11 November 1986 RE: Text Amendment - Essential Services - Cellular Telephones FILE NO: 758.09 - 86.38 The application of the Cellular One Telephone Company to construct a trans- mission facility has spurred concerns that the City's Zoning Ordinance may not deal adequately with the issue of antenna construction for essential services in the City. While the intent of the current language is inter- preted to require a conditional use permit, it was written prior to cellular technology. Therefore, we have included a proposed text amendment which should help to clarify the ordinance in this regard, The requirement of a conditional use permit will cause any such application to meet the criteria listed in the Administrative Section of the ordinance, which are as follows: C. The Planning Commission shall consider possible adverse affects to the proposed amendment or conditional use. Its judgement shall be based upon (but not limited to) the following factors: 1. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Land Use Plan. 2. The proposed site is or will be compatible with present and future land uses of the area. 3. The proposed use conforms with all performance standards contained herein. 4. The proposed use will not tend to or actually depreciate the area in which it is proposed. 5.
