At some point in the <br />consideration of this project by the City Council, we were <br />informed that the City intended to use the same property as part <br />of a trail system for the City parks. Unfortunately, no one has <br />yet provided us with legal descriptions relating to the trail <br />system. Without specific legals, the relevant legal documents <br />describe the entire drainage easement, which includes more <br />property than necessary for the trail system. <br />It would be beneficial and hopefully more economical if the <br />property to be acquired for a trail system is substantially less <br />than the property to be acquired for the drainage project. Would <br />you please submit this matter to the Council for its <br />consideration so that appropriate legal descriptions can be <br />prepared relative to the trail easements. <br />Would you please review your file and contact me so that we <br />may discuss whether Project 86 -13 includes the construction of <br />the trail system. If it does not, the Council should adopt a <br />resolution combining the two projects for the purpose of <br />construction and acquisition of the necessary easements. I am <br />enclosing a resolution ordering condemnation relative to the <br />trail project. This resolution should be completed by inserting <br />the appropriate project number. It then should be submitted to <br />the Council for its consideration. <br />PAGE -6 <br />
