During the initial stages of <br />excavation, the contractor informed me that there is a 12 inch <br />natural gas line on my property that is running adjacent to <br />Edgerton Street that has not been buried properly. It is <br />my understanding that this gas line is only buried to a depth of <br />4 inches. it is also my further understanding that the law requires <br />that this line be buried at least 36 inches below the ground. <br />As a result of this gas line being at the depth that it is, <br />I am unable to obtain a driveway permit. <br />At this time, I am unsure why this pipeline was not buried <br />the appropriate depth at the time of installation. I am putting <br />you on notice that if I am unable to get a driveway permit due <br />entirely to the depth of this gas line, I will seek appropriate <br />action against Northern States Power for any resulting damages. <br />I would respectively request that you contact the appropriate <br />city, county and state agencies and coordinate a program for <br />re -space installation of this gas line. <br />I look forward to hearing from you in the future. <br />MJF;jhk <br />cc; City of Little Canada <br />Sincerely, <br />Michael J.
