PLANNING REPORT <br />northwest EssociEted consultants, inc. <br />TO: Little Canada Planning Commission <br />FROM: Michelle Hren /Stephen Grittman <br />DATE: 9 June 1987 <br />RE: Little Canada - Theran Rusch CUP and Variance Request <br />FILE NO: 758.09 - 87.34 <br />BACKGROUND <br />Theran F. Rusch of 2731 Lakeshore Avenue in Little Canada has submitted an application <br />for a conditional use permit for a building relocation for a garage and an application <br />for a variance request from the side yard setback for this garage. As shown on the <br />location map, the property is located within the Shoreland District and is also zoned <br />R -1, Single Family Residential. The Shoreland District is superimposed upon all zoning <br />districts as contained. The regulations and requirements imposed by the Shoreland <br />District shall be in addition to those established for districts which jointly apply. <br />Under the joint application of districts, the more restrictive requirements shall apply. <br />The property in question does not abut the water, therefore the sewered non - abutting <br />requirements of the Shoreland District apply. The lakes in the area are classified <br />General Development. <br />The lot meets the required 10,000 square feet in area and the 75 foot lot width re- <br />quirement. The side yard setbacks are followed from the R -1 District which are as <br />follows: the front yard setback is not less than 30 feet, the rear yard setback is not <br />less than 30 feet and the side yard setback in this case shall have side yards no less <br />than 10 feet. <br />Conditional Use Permit <br />A conditional use permit is required for the relocation of structures in the City. <br />Recently the home on this lot had been relocated to this site. Previously the lot was <br />vacant. The current application is to relocate a two car garage to this site. Private <br />garages are considered a permitted accessory use in the R -1 District and must meet <br />zoning requirements. The zoning requirements have been outlined previously and as such, <br />the second request involves a variance from the required side yard setback. <br />Based on our office's review of this conditional use permit request we feel the request <br />to relocate a garage to this site is reasonable with the provision that all zoning re- <br />Page 38 <br />4601 excelsior blvd., ste. 410, minneapolis, mn 55416 (612) 925 -9420 <br />
