PLANNING REPORT <br />nni thwect assocIEted consul ants, <br />T0: Little Canada Planning Commission <br />FROM: Steve Grittman <br />DATE: 13 May 1987 <br />RE: David Wright Subdivision <br />FILE NO: 758.09 - 87.19 <br />BACKGROUND <br />In 1976, David Wright initiated a series of lot splits and a partial street dedi- <br />cation in the area of Allan Avenue between Vanderbie and DeSoto Streets. The <br />applicant now wishes to divide another lot which will front on the partially dedi- <br />cated street (see Exhibit A). <br />ANALYSIS <br />The lot split being proposed requires the dedication of the remainder of the street <br />width. As 30 feet has already been provided, 20 feet of additional right -of -way is <br />necessary. One problem is that Lot 1 at the corner of Allan and Vanderbie was <br />divided but the right -of -way was not dedicated. Exhibit C shows the approved sub- <br />division of Lot 1, Exhibit D is a copy of the minutes from the Council on April 23, <br />1975 which lists the requirement that "30 feet is allowed for the future street ". <br />While the 30 foot reservation was required, a dedication of the right -of -way was <br />apparently not filed. This right -of -way is necessary to provide adequate access to <br />•the proposed new parcel. <br />As demonstrated by the section maps, the applicant, Mrs. Philip Johnson, intended to <br />comply with the City's request as the lot was recorded as the west 130 feet of Lot <br />1, Block 3, changed from the original application of 120 feet. The aerial photos, <br />as well as site inspections indicate that adequate room has been reserved for the <br />road. A letter has been sent to the affected property owners indicating the City's <br />intent to require dedication of the street. <br />All proposed lots are of adequate area and width. Subject to acquisition of the street <br />right -of -way, the subdivision proposal meets City requirements. <br />RECOMMENDATION <br />�n <br />Page 61 <br />
