Thome <br />324 Brooks Avenue East <br />St. Paul (Little Canada), <br />Minnesota 55117 <br />Dear Mr. Thome <br />You, on your own behalf and on the behalf of some of your neighbors, <br />have asked me to give you my legal opinion regarding your question, <br />which I have phrased as follows: <br />Would it be lawful for the Village of Little Canada to <br />issue permits allowing the construction of residences <br />on the following parcels of land situated in the "Roy <br />Wilson Addition ": <br />The Northerly 110 feet of each of Lots 1 and • <br />12, Block 1, and Lots 1 and 12, Block 2. <br />The Southerly 110 feet of each of Lots 1 and <br />12, Block 1, and Lots 1 and 12, Block 2. <br />You have furnished to me certain information indicating that all of <br />said parcels are rectangular in shape, being 100 feet from east to <br />west and 110 feet from north to south. You have given me a copy of <br />Village of Little Canada Ordinance No. 45, known as the Zoning Ordi- <br />nance of the Village of Little Canada, and Ordinance No. 52 which <br />amends Ordinance No. 45. I am assuming said ordinances to be pre- <br />sently in full force and effect, at least with respect to the problem <br />at hand. <br />It appears from the zoning map that said parcels are within an R -1 <br />district (single family residence district). Pertaining to the <br />single family residence district, Section 11 -10 of said Ordinance <br />No. 45 as amended, (D) reads: <br />The following minimum requirements shall be observed: <br />Set Backs <br />Avg. Min. Min. Side <br />Lot Area Width Front Depth Front Side Rear Street <br />10,000 sq.ft. 75 ft. 40 ft. 125 ft. 30 ft. 5 ft. 30 ft. 30 ft. <br />Page 7 <br />
