Little Canada Planning Commission <br />December 3, 1987 <br />Page Two <br />The City zoning ordinance was recently amended by adding the following section: <br />912.040.F. <br />Commercial recreation. Those establishments serving alcoholic beverages, <br />pool hall, bingo, golf, indoor firearms /archery ranges, and amusement <br />centers as a principal use, provided that: <br />a. If located within a shopping center, the use has its own exclusive <br />exterior access. <br />b. Any and all applicable local, state and federal laws, permits <br />licenses and operational regulations are complied with. <br />c. The use is located and developed so as not to create an incompatible <br />operation problem with adjoining and neighboring commercial and /or <br />residential uses. <br />d. The hours of operation shall be subject to City Council control <br />and change as a means to maintain compatibility of uses and activities. <br />e. The provisions of Section 921.O10.0 of the Ordinance are considered <br />and satisfactorily met. <br />This proposal is governed by this section of the ordinance and appears to meet <br />conditions a, b, and c with the information submitted thus far. Condition d, <br />as stated earlier, will have to be finalized by the City Council. Condition e <br />lists other general factors to consider with a CUP application. The proposal <br />meets all of the requirements of that section. <br />Another concern that this proposal raises is in regards to the use and operation <br />of amusement devices or machines. These may, if the City Council so. chooses, <br />be controlled as a part of the Conditional Use Permit approval process. Section <br />811 of the City code defines and regulates amusement centers and devices. An <br />amusement center is defined as "Any...area... the purpose and use of which is <br />to provide amusement or entertainment through the operation of four (4) or more <br />amusement devices." The applicant has not expressed at this time any definite <br />plans regarding amusement devices. Staff suggest that amusement devices are an <br />acceptable accessory use in the billiards operation and the number of devices <br />or machines be limited to a maximum of five (5). If the applicant is permitted <br />to have amusement devices, than their use and operation will be subject to the <br />provisions of Sectiom811 of the City code. <br />RECOMMENDATION <br />It is our recommendation that the Conditional Use Permit be approved for the <br />billiards center, subject to the following requirements: <br />1. The exclusive exterior access is kept as shown on the submitted floor <br />plan. <br />2. Any and all applicable laws, permits, licenses and operational regulations <br />are complied with. <br />3. The operation remains compatible with all adjoining and neighboring uses. <br />4. The hours of operation shall be subject to City Council control and change. <br />Page 14 <br />
