changes in plan to be made and appropriately alter the affected construction. <br />Section B. Replacement of Castings <br />In connection with the adjustment and installation of inplace utility facilities to be <br />performed by the state's contractor under State Project 6280 -233 (T. H. 35E =390) and <br />State Aid Projects 62- 621 -03, 200 - 020-01 and 200 - 103 -01, the City hereby agrees to <br />furnish the state's contractor with new castings and /or parts therefor when replacements <br />are required, without cost or expense to the State or the state's contractor, excepting <br />replacements required of castings and /or parts broken or damaged by the state's <br />contractor. <br />Section C. Addition Drainage <br />It is hereby understood and agreed that, upon the satisfactory completion of State <br />Project 6280 -233 (T.H. 35E =390) and State Aid Projects 62- 621 -03, 200 - 020 -01 and 200- <br />103-01 construction, neither party to this agreement shall drain any additional drainage <br />into the storm sewer facilitites constructed under said projects that is not included in <br />the drainage for which said storm sewer facilities were designed without first obtaining <br />permission to do so from the other party. The County shall, prior to granting permission <br />to the City, obtain permission from the State. <br />Section D. Maintenance - County <br />It is hereby understood and agreed that, upon the satisfactory completion of State <br />Project 6280 -233 (T.H. 35E =390) and State Aid Projects 62- 621 -03 and 200 - 020 -01 and <br />200 - 103 -01 construction, the County shall thereafter provide for the proper maintenance <br />of the entire portion of County State Aid Highway 21 (Little Canada Road) and County <br />Road 103 (Centerville Road) and all of the facilities a part thereof constructed under <br />said state projects except for the Bridge 62896 portion of County State Aid I- Iighway <br />21 (Little Canada Road), the relocated portion of Country Drive, walks and storm sewer <br />trunk lines, east of Engineers Station 13 +75. Said maintenance shall be understood to <br />include, but not be limited to, snow and debris removal, resurfacing and /or seal coating <br />to any other maintenance activities necessary to perpetuate said roadway portion in a <br />safe and usable condition. Parking and other regulations will be controlled by the County. <br />It is hereby understood and agreed that, upon the satisfactory completion of State <br />Project 6280 -62896 (T.H. 35E =390) construction, the County shall thereafter provide for <br />snow and debris removal of the entire portion of Bridge 62896 and all of the facilities <br />a part thereof constructed under said state project. <br />Section E. Ownership and Maintenance - City <br />It is hereby understood and agreed that upon the satisfactory completion of said State <br />Project, the City shall own, operate and maintain the relocated portion of Country <br />Drive, the concrete and bituminous walks adjacent to CSAH 21 (Little Canada Road) <br />and County Road 139 (Centerville Road) and the storm sewer trunk lines east of <br />Engineers Station 13 +75 constructed under this project. Said maintenance shall be <br />understood to include all activities necessary to perpetuate said facilities in a safe and <br />usable condition compatible with the rest of the improvements constructed under this <br />project. <br />Page 97 <br />87022 <br />Page 7 of 9 <br />
