MINUTES <br />Planning Commission <br />October 8, 1987 <br />Foyt pointed out that this will add costs to his proposal. <br />DeLonais pointed out that the two homes do not line up as proposed. <br />The Planner replied that the Code does not require homes to be in <br />line, just that they meet minimum front yard setbacks. <br />Herkenhoff asked if any precedents would be set by this approval. <br />The Planner stated that by Zoning Ordinance requirements, there was <br />not necessarily a hardship present. However, the Planner stated that <br />if a variance was granted he did not feel the situation would come up <br />again that would cause a precedent to be considered. The Planner <br />pointed out that this situation is very uncommon. <br />Timmons felt the variance should be approved to facilitate resolution <br />of the problem. <br />Foyt pointed out that he cannot subdivide his property until he knows <br />how the City will react to his variance request. <br />Timmons pointed out that it is the garages of the two homes that <br />will be six feet apart. Timmons asked if the City should require <br />that no building permit is issued until the subdivision is approved. <br />The Planner noted that the title of the property will have to be <br />cleared before the property owner would be able to obtain a mortgage. <br />Foyt stated that he wanted the variance matter settled with the City, <br />and then the attorneys could begin to work on the subdivision. Foyt <br />stated that he did not want to proceed building his home until <br />the situation is resolved. <br />Timmons recommended approval of the sideyard setback variance as <br />requested by Ron Foyt, 2403 Reidmond Avenue, and indicating the <br />Commission's feeling that the City Council should approve a <br />subdivision of the property to resolve the house location problem. <br />Motion seconded by Perlinger. <br />Motion approved 4 - 1. Mr. DeLonais voting against as he expressed <br />concern about the legality of the matter. <br />Conditional Mr. Steve Sertich appeared before the Commission requesting approval <br />Use Permit of a conditional use permit to locate a sandwich shop within the <br />Steve Sertich U.S. Swim and Fitness building. Sertich reported that he has also <br />applied for a wine and beer license for the shop. <br />DeLonais asked if Sertich was agreeable to the recommendations made <br />by the City Planner. <br />Page 7 <br />
