The issuance of <br />the building permit was on May 24, 1982. It was completed late fall of <br />1982. During the time of construction, records indicate that inspections <br />were made. However, on March 6, 1987 I received a letter (copy enclosed) <br />from Joel Hessen, Attorney for Mr. and Mrs. Foyt the owners of Lot 5, <br />stating that there is an encroachment as mentioned above. <br />The question one may ask is how does this happen? For one reason or <br />another there was a human error of improper documentation of the <br />property. What necessary action can be made to make Lot 5 buildable? <br />Joel Hessen asked what type of variance must be obtained prior to any <br />legal action on their behalf, Presently Mr. Hessen informed me by phone <br />that he will be seeking avenues of correction by approaching City Council <br />and the owner of Lot 4 in the following ways: <br />(a) Variances, side yard set backs, frontage measurements. <br />(b) Encroachment of property be purchased. <br />I truly believe Joel Hessen is just as concerned with this problem as we <br />are and awaits to hear from you with your recommendations. <br />kv <br />Page 50 <br />
