Jakubowski of 2948 Rice Street has submitted an application for a <br />variance request from the side yard setback. The property is zoned I -1, Light <br />Industrial. As shown on the attachments, EAC does not have direct access onto a <br />public street, rather access is gained by way of access easements. <br />ISSUES AND ANALYSIS <br />The light industrial lot requirements as outlined in Section 914.050 of the <br />Ordinance requires a 15 foot side yard setback. The applicant is proposing a 22 <br />foot addition on the south side of the building which would leave approximately <br />a one (1) foot setback. To the south and east of the property is the bingo <br />property. As shown on the site plan, the east side of the building is proposed <br />for future addition,therefore,it appears the intent is to eventually expand <br />easterly. Section 922.010, Subd. C outlines the conditions governing variance <br />requests where it states that special conditions and circumstances must exist <br />which are unique to the property or building. It also states that a variance <br />is justified in order to make reasonable use of the land, structure or building <br />and that the variance is the minimum variance. In this particular request, it <br />appears that there is no special conditions or circumstances that are unique to <br />the property that would justify a variance. Additionally, it also appears that <br />since future expansion is intended to the east of the building that there is <br />reasonable use of the property available without a variance.
