MINUTES <br />CITY COUNCIL <br />APRIL 24, 2013 <br />NORM'S TIRE <br />LAND USE <br />AWARD BIDS <br />FOR SPRUCE <br />STREET & <br />PINETREE <br />POND <br />IMPROVEMENTS <br />The City Planner reported that he received a call from someone <br />representing a business that does light service work on emergency <br />vehicles. The business buys used vehicles from communities and <br />repurposes them for sale to other communities. The caller asked if there <br />would be City support to locate this business on the former Norm's Tire <br />property. The Planner reported that the business would involve outdoor <br />storage and overnight parking of the vehicles in for service. The Planner <br />reported that given the nature of this business and the B -2 Zoning District <br />requirements, a Zoning Code amendment would likely be necessary to <br />accommodate the business. The Planner indicated that he told the caller <br />that it was unlikely that the Council would support outdoor storage on this <br />site. <br />The Council discussed this potential use, and it was their consensus that <br />they would not support outdoor storage on the former Norm's Tire site. <br />The City Engineer reviewed his April 24, 2013 report providing a bid <br />summary for the 2013 Street and Utility Improvements consisting of the <br />reconstruction of Spruce Street and the construction of the Pinetree Pond <br />Development. Seven bids were received with the low bidder Frattalone <br />Companies in the amount of $1,040,802.35. <br />The Engineer noted that at the Spruce Street Improvement Hearing, the <br />City had informed the property owners that it would hold the Assessment <br />Hearing prior to bid award. Therefore, the City Engineer recommended <br />that the Council call for an Assessment Hearing at this time, and <br />recommended May 15`1' for the hearing date. The bid award could occur <br />immediately following the assessment hearing. The Engineer indicated <br />that given the developers need to remove two homes as part of the <br />Pinetree Ponds construction process, the May 15th bid award date should <br />not pose a problem. <br />Montour asked about the alternate in the bid package. The Engineer <br />reported that the alternate relates to the realignment of Spruce Street at <br />Country Drive. He noted that additional right -of -way is necessary from <br />the Lapham Hickey property in order to accomplish the realignment. If <br />that right -of -way cannot be obtained on a voluntary basis, the plan would <br />be to reconstruct Spruce Street in its present location. The City <br />Administrator reported that staff has discussed the need for the additional <br />right -of -way with Lapham Hickey, and hopes to have an answer from <br />them by May 8 '1i. <br />Blesener introduced the following resolution and moved its adoption: <br />14 <br />
