Reports required by M.S. 626.52 and 62633 <br />are CONFIDENTIAL. The name of person(s) <br />making such report shall not be disclosed except <br />as provided by M.S. 626.54. <br />I.) Maltreatment of minors reports (PRIVATE). <br />Reports required by M.S. 626356 are PRIVATE <br />except that such reports shall be made available <br />to the prosecuting authority. <br />The records shall be collected and maintained <br />in accordance with the provisions of M.S. <br />15.162 to 15.168, and an individual subject <br />of a record shall have access to the record in <br />accordance with those sections, except that the <br />name of the reporter shall be disclosed only <br />by the local welfare agency if the report is found <br />to be unsubstantiated, or by the local welfare <br />agency upon court order if the report is found <br />to be substantiated. <br />Records maintained by local welfare agencies, <br />the police department, or county sheriff under <br />this section must be destroyed as follows: (1) <br />All records relating to reports which, upon in- <br />vestigation, are found to be false shall be des- <br />troyed immediately; (2) All records relating <br />to reports which, upon investigation, are found <br />to be substantiated shall be destroyed seven <br />years after the date of the final entry in the case <br />records; and (3) All records of reports which, <br />upon initial investigation, cannot be substan- <br />tiated or disproved to the satisfaction of the <br />local welfare agency, local police department, <br />or county sheriff may be kept for a period of <br />one year. If the local welfare agency, local pol- <br />ice department, or county sheriff is unable to <br />substantiate the report within that period, <br />each agency unable to substantiate the report <br />shall destroy its records relating to the report. <br />T% Juvenile records (PRIVATE with exceptions). <br />Peace officers' records of children shall be kept <br />separate from records of persons 18 years of <br />age or older and shall not be open to public <br />inspection or their contents disclosed to the <br />public except by order of the juvenile court. <br />No photographs of a child taken into custody <br />for any purpose may be taken without the con- <br />sent of the juvenile court. (M.S. 260.161, <br />Subd. 3.) <br />4. Elected officials correspondence (private) <br />(M.S. 15.1697) <br />Correspondence between individuals and elected <br />officials is PRIVATE data on individuals, but may <br />be made public by either the sender or the reci- <br />pient. <br />S.
