The City could decide to vacate Lake Street between Stark and Ruth Streets, retaining <br />an easement for trail purposes. While the Demont property would not require a variance <br />then because it would no longer be a corner lot, the City would be denying access to <br />the remaining lots which front on Lake Street. Although those Tots are unbuildable due <br />to insufficient size, the legal difficulties of such action suggest that a better solution <br />could be found. <br />4. Rather than vacate all of Lake Street between Stark and Ruth Streets, the City could <br />vacate only eleven feet of the street adjacent to the applicant's property (see attached <br />exhibit). This would allow him to build without need for a variance; lots on Lake Street <br />would not be denied access: and the potential for Lake Street to be put through at <br />some later date would still exist. Obviously, it would only be reasonable for the <br />owner of the property across Lake Street to request the same consideration at some <br />future date. If such future requests for vacation of Lake Street were granted, a right - <br />of -way of 38 feet would remain. This may be adequate to provide access to the <br />problem lots. <br />It must be noted that this approach does not resolve the problem of Lots 4, 5 and 48. <br />They would remain unbuildable. <br />5. As a last resort the City may wish to investigate tax increment financing as a means <br />of resolving the problem of substandard lots in the Lake Street vicinity. This approach <br />should only be pursued if all other possibilities have been exhausted. <br />RECOMMENDATION <br />The ultimate solution to this problem is still for the owners of Lots 1 -5 and 48 to get together, <br />combining their lots and then splitting them into two buildable lots fronting on Ruth Street. <br />If, for some reason, this cannot be accomplished, the option discussed in 4 above is recom- <br />mended subject to favorable review and comment by the City Engineer as to the 38 foot right - <br />of -way for Lake Street.
