Hanson <br />MEMORANDUM <br />TO: Mayor Blesener and Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: May 17, 2013 <br />RE: Amendment to Tobacco Ordinance <br />As you will recall, one of the licensing requirements for Tobacco Stores is that license renewal <br />application materials include "sufficient financial information" to show that the store is in <br />compliance with the requirement that 90% of gross revenue is derived from the sale of approved <br />products. Approved products include cigars, cigarettes, loose tobacco, cigarette or cigar lighters, <br />and tobacco - related devices. Another requirement is that no more than 50% of the gross revenue <br />of the store may be derived from the sale of tobacco - related products (any pipe, rolling papers, <br />ashtray, or other device which enables the chewing, sniffing or smoking of tobacco or tobacco <br />products). <br />In enforcing the ordinance, it has been onerous for City staff to delve into a mass of business <br />receipts and tax returns. As a result, it would be staffs recommendation that the Tobacco <br />Ordinance be amended modifying the requirement for submission of financial information. Staff <br />is proposing that a statement be included on the Tobacco Store License Application that the <br />business owner would be asked to sign in which the owner certifies compliance with these Code <br />requirements. Only if the City deems necessary would the applicant would be required to submit <br />financial information. <br />If the Council is in agreement with this recommendation, staff is requesting that the attached <br />ordinance amendment be adopted. <br />1 <br />
