Prior to promulgating bingo regulations or issuing a bingo <br />license, the local unit of government shall consult with the local building inspector, if any, <br />and the fire and police authorities. A local unit of government which permits bingo but <br />has not adopted regulations shall be deemed to have adopted the provisions of Laws 1976, <br />chapter 261 as its regulations. A local unit of government may amend its regulations. <br />Subd. 2. A local unit of government that permits bingo shall establish a system for <br />licensing organizations to conduct bingo occasions, and shall act on a bingo license <br />application within 180 days from the date of application, but shall not issue a license until <br />at least 30 days after the date of application. A license shall be valid for one year, and <br />may be suspended or revoked by the issuing authority for violation of Laws 1976, chapter <br />261 or of any local ordinance relating to bingo. <br />Subd. 3. Each year the local unit of government shall allocate an amount of money at <br />least equal to the lesser of $25,000 or 25 percent of the amount it collected and retained <br />from bingo fees, bingo licenses, and bingo taxes in the preceding year for the supervision, <br />regulation and inspection of the conduct of bingo. <br />Laws 1976, c. 261, § 6. <br />Library References C.J.S. No compensation shall be paid to any person in connection with a bingo <br />occasion except an active member of the organization, or its auxiliary, or the spouse or <br />surviving spouse of an active member, conducting the bingo occasion nor shall any person <br />not an active member of the organization or its auxiliary or the spouse or surviving spouse <br />of an active member participate in the conduct of a bingo occasion, except by resolution of <br />a majority of the membership, recorded in the official minutes of the organization, <br />non - management assistants who are not active members of the organization, or its <br />auxiliary, or the spouse or surviving spouse of an active member, may be hired to assist <br />members in conducting a bingo occasion. Compensation shall not exceed $20 for a bingo <br />occasion. <br />Subd. 2. No more than 104 bingo occasions each year or two bingo occasions each week <br />shall he conducted by any organization, except that the local unit of government issuing <br />Ole license may permit additional bingo occasions to be conducted by an organization. A <br />bingo occasion shall not continue for more than four consecutive hours. <br />Subd. 3. (1) Any person or corporation, other than an organization, which leases any <br />premises that it owns to two or more organizations for purposes including the conduct of <br />bingo occasions, shall not allow more than four bingo occasions to be conducted on the <br />premises in any week. <br />(2) Any organization which leases any premises to one or more other organizations for <br />purposes including the conduct of bingo occasions shall use the proceeds of the rental, less <br />reasonable sums for maintenance, furnishings and other necessary expenses, only for <br />lawful purposes as defined in section 349.12. Not less than once each year the organization <br />shall report to the licensing authority the disposition of all receipts which it has received <br />during the reporting period from the rental of its facilities to other organizations for <br />purposes including the conduct of bingo occasions. <br />(3) No organization shall conduct bingo on any leased premises without a written lease <br />for a term at least equal to the remainder of the term of the bingo license of the <br />organization. Lease payments shall be at a fixed monthly rate, or rate per bingo occasion, <br />not subject to change during the term of the lease. No such lease shall provide that rental <br />payments be based on a percentage of receipts or profits from bingo occasions. <br />Subd. 4. Prizes for a single bingo game shall not exceed $100 except prizes for a game <br />of the type commonly known as a "cover -all" game. "Cover -all" prizes may exceed $100 <br />provided that the aggregate value of such prizes for a bingo occasion shall not exceed $500. <br />109 <br />
