AGREEMENT AND WAIVER OF RIGHT TO APPEAL <br />THIS AGREEMENT, dated this _ day of , 198 <br />by and between the City of Little Canada, a municipal corporation, <br />hereinafter called City, and North Star Estates, a Minnesota <br />partnership, d /b /t. North Star Estates Mobile Home Park, hereinafter <br />called North Star. <br />WITNESSETH: <br />wt1EREAS, North Star is the owner of a mobile home park known <br />as North Star Estates located in the City of Little Canada, <br />Minnesota, and <br />WHEREAS, North Star agrees that it is bound by the terms <br />of a previous agreement with the City which provided for the <br />construction by North Star of a roadway at its expense for the <br />purpose of providing an additional entrance from South Owasso <br />Boulevard into said mobile home park, and <br />WHEREAS, the construction of said road will necessitate a <br />public improvement for the installation of 18 feet of culvert <br />pipe, and <br />WHEREAS, the owners of North Star will petition the City <br />Council for said public improvement, pursuant to the applicable <br />provision of Minn. Stat. Chapter 429, and <br />WHEREAS, the costs of said public improvement for the installa- <br />tion of 18 feet of culvert pipe shall be paid as provided herein, <br />and <br />WHEREAS, City is obligated to enforce said agreement in <br />order to ensure the health, safety and welfare of the residents <br />of said mobile home park, and <br />WHEREAS, the leasing by North Star of sites for mobile homes <br />during the ten ye -s since the opening of said park has resulted <br />in mobile homes occupying all of the lots in said park, thus <br />leaving no open areas which would allow for the creation of a <br />new entrance, and <br />WHEREAS, it now is apparent that in order to construct said <br />new road entrance to said park, one of the existing mobile home <br />3J <br />
