from County Road B, for use in creation of a new access road as further described in <br />paragraph 2(b) below. <br />2. Actions by Tex -Sota. <br />(a) After vacation of Rosedale Avenue and Courtland (or Jackson) Street <br />by the City as required in paragraph 1(a) above, Tex -Sota and Naegele, Inc. will convey <br />the Ponding Area to the City, in consideration for the City's future conveyance to <br />Tex -Sota and Naegele, Inc., as their interests shall appear, of the Exchange Property. <br />(b) After completion of the conveyances described in paragraph 1 above <br />and this paragraph 2, and after closing upon Tex - Sota's industrial revenue bond <br />financing upon the Property, Tex -Sota shall, using gravel salvaged from the City's <br />existing utility access road, construct a private roadway running from County Road B in <br />a northerly direction, as shown on Site Plan Drawing No. 1, dated February 27, 1981. <br />Tex -Sota shall further construct from said private roadway, a single -lane service road <br />to the City's utility substation located in the northerly portion of the Ponding Area, as <br />shown on said Site Plan.
