Page 2 <br />Letter to City Council Little Canada <br />September 9, 1982 <br />A study of the section map of this area shows that the <br />residences lying east of the Kroiss site on the north side of <br />County Road B2 vary from about.23 acres to about.60 acres and <br />with Lot frontages of 60 feet co 130 feet, with most of them <br />having a frontage on County Road B2 of 100 feet. As Mr. Kroiss <br />has pointed out to you he has a substantial investment in this <br />property and his real estate taxes have increased from $1900 to <br />$4900 per year. <br />The resolution denying the preliminary plat states in <br />part "the plat does not conform to the city's ordinance and <br />that it does not show due regard for all natural features in- <br />cluding topography, tree growth, historical spots and natural <br />boundries and does not relate well to the character of the <br />existing neighborhoo4...." and then goes on to state that you <br />would not object to the plat if Lots 2 and 3 were joined to- <br />gether as a single lot. From an examination of your minutes <br />of July 28, 1.982, which I presume is the only record you have <br />of what transpired at this meeting, it is difficult to imagine <br />the denial of the preliminary plat meeting the test of reason- <br />ableness in light of the developement of the surrounding pro- <br />perty and particularly in light of your professional planners <br />report, Planners Report of April 30, 1982. Litigatilg matters <br />of this nature are both time consuming and expensive to all <br />parties concerned and it is requested that you carefully con- <br />sider the application again. after first examining physically <br />the configurations of the lanu, the location of the drainage <br />easement, and other topographical and landscaping features. <br />Mr. Kroiss is an experienced land developer who has literally <br />built hundreds of houses in Ramsey County and intends to live <br />on this site himself. He has a personal stake in the developement <br />of this property and is presently preparing plans for the potential <br />developement of proposed Lot 4 for a future home for himself. <br />At your meeting of July 28, Mr. Kroiss indicated that he would <br />not sell proposed Lot 2 until he first sold the existing house <br />on proposed Lot 3 and gave its purchaser a opportunity to ac- <br />quire Lot 2 as well. Mr. Kroiss is prepared to sign a binding <br />legal document to this effect. <br />Mr. Kroiss has requested that I invite members of the <br />Council to personally come on his .property and examine its <br />configuration and the developement of the surrounding properties <br />so that you will better understand his reasons for the config- <br />uration of the proposed .plat. <br />JED:jw <br />cc: R.
