CITY OF BLAINE <br />ORDINANCE NO. 755 -. <br />AN ORDINANCE AMENDING ARTICLE IV, CHAPTER 4, <br />OF THE BLAINE MUNICIPAL CODE RELATING TO <br />AMUSEMENT CENTERS AND AMUSEMENT DEVICES <br />THE CITY OF BLAINE DOES ORDAIN: <br />Article IV of Chapter 4 of the Blaine City Code is amended to <br />read: (Added portions are underscored and deleted portions are <br />shown in brackets.) <br />Sec. 4 -40. Definitions <br />For the purpose of this article, the following terms shall <br />have the respective meanings ascribed to them: <br />Amusement Center: Any room, place or space available for <br />public patronage, operated as a business, which utilizes in its <br />operation equipment and games [amusement devices], including, but <br />not limited to, pool tables, billiard tables, table tennis tables, <br />foosball tables, pinball machines, or any mechnical or electronic <br />amusement device, and which derives its [the] principal source of <br />revenue [of which is derived] from the use and operation of such <br />equipment and games [devices]. An amusement center as defined in <br />this article shall not include bowling alleys. <br />Amusement device: An "amusement device" is an electronic or <br />mechanical game of skill or chance, requiring the payment of money <br />to play or operate. An "amusement device" is not a "gambling <br />device" as defined by Minnesota Statutes. <br />Operate: To conduct, manage, supervise, maintain or keep. <br />Sec. 4 -41. License for Operation of an Amusement Center and <br />Amusement Device [Required]. <br />(1) No person shall operate an amusement center within the <br />limits of the City without an amusement center [a] licerse and a <br />special use permit, pursuant to Section 34.15 (a) of the Zoning Code. <br />(2) No person shall operate an amusement device within the <br />City without an amusement device license. <br />(3) Operation of four (4) or more amusement devices in a <br />business establishment is prohibited, unless the premises is <br />licensed as an amusement center. <br />Section 4 -42. Same - Application <br />Applications for an amusement center and amusement device <br />[a] license shall be made in writing to the City Clerk and shall <br />be verified by the applicant and accompanied by the license fee <br />required below. The application shall contain such information <br />as may be required, including, but not limited to, the following: <br />
