THIS AGREEMENT, Entered into this 28th day <br />197 5 between Independent School District No. <br />the "District ") as lessor and the City of Little <br />inafter the. "City "). as lessee. <br />of August <br />623 through its Board (hereinafter <br />Canada'through its Council (here- <br />WITNESSETH, That in consideration of the covenants herein contained, said <br />District hereby leases to said City that' certain land and premises comprising that <br />part of the school site owned by the District and located within the boundaries of <br />the City southeast of the intersection of Eli Road and Centerville Road, and as <br />designated on the attached site plan identified as Exhibit A, subject to the <br />following: <br />1. TERM -This lease shall be in effect for a period of 15 years from <br />and after the day of 19 75 <br />2. OPTION TO RENEW -The City has the option to renew this lease for a period <br />of 10 years under the same terms and conditions of ng ivi <br />notice to the District of its intention to do so. g 90 days written <br />The City in consideration of said lease, hereby covenants as follows: <br />3. USE OF LEASEHOLD -Said land and premises as described herein shall be-used <br />exclusively for Park and Recreation purposes by the City, its successors and assigns. <br />4. CONDITION OF PREMISES -The City has examined and knows the condition of <br />said leased land and premises., acknowledges that it has received the same in good <br />order and repair, and that no representation as to the condition or state of repairs <br />thereof has bean made by the District; and•the City expressly assumes the risk of <br />all defects latent or apparent; and the City agrees to repair, restore or replace, <br />to the satisfaction of the District any fixtures, equipment or machinery included <br />in said leasehold, which may hereafter be found injured, defective, damaged or <br />missing. <br />• <br />5. RESPONSIBILITY FOR DAMAGE'TO PREMISES -The City assumes responsibility for <br />loss, damage, or injury to the leasehold caused by its officers, employees, invitees <br />or others while entering, within or departing from the leasehold in connection with <br />the lessee's activities, or by its occupancy of the leasehold, other than by <br />reasonable wear and tear. • <br />6. MAINTENANCE -The City shall be responsible for maintenance of the leased <br />land and premises in good repair and in a safe and not unsightly condition. <br />7. SUPERVISION -The City shall supply personnel as necessary to supervise <br />leased land and premises when the same are available for general public use. <br />8. UTILITIES -The City agrees to promptly pay all costs of electricity, gas, <br />oil, sewer, water, and other utilities as may be provided to such leased land <br />and premises. <br />the <br />9. ACKNOWLEDGMENT OF PARTICIPATION -The City shall make notice of the District's <br />participation in providing the leased land and premises on any and all signs or <br />printed information available to the public in a manner approved by the District. <br />
