Chlebeck <br />July 8, 1982 <br />Page Two <br />planning and design of sites; access to solar <br />energy; and the protection and conservation <br />of floodplains, shore lands, soils, water, <br />vegetation, energy, air quality, and geologic <br />and ecologic features. The regulations shall <br />require that subdivisions be consistent with <br />the municipality's official map, if one exists, <br />and its zoning ordinance, and may require con- <br />sistency with other official controls and the <br />comprehensive plan. . . the regulations may <br />permit the municipality to condition its <br />approval on the construction and installation <br />of sewers, streets, electric, gas, drainage, <br />and water facilities, and similar utilities <br />and improvements. . .the regulations may <br />permit the municipality to condition its <br />approval on compliance with other requirements <br />reasonably related to the provisions of the <br />regulations and to execute development con- <br />tracts embodying the terms and conditions of <br />approval. . . <br />The stated purpose of the Little Canada Subdivision Ordinance <br />is found in Section 1001.020, as follows: <br />It is the purpose of this ordinance to make <br />certain regulations and requirements for the <br />platting of land within the City of Little <br />Canada pursuant to the authority contained in <br />Minnesota Statutes Annotated, which regulations <br />the City Council deems necessary for the health, <br />safety and general welfare of this community. <br />It is our opinion that the stated purpose of the Little <br />Canada Subdivision Ordinance includes the authority granted to <br />the City by Minn. Stat. Section 462.358, Subd. la, i.e., <br />To protect and promote the public health, safety, <br />and general welfare, to provide for the orderly, <br />economic, and safe development of land. <br />Certain specific provisions of the Subdivision Ordinance <br />relate to the City Council's legislative discretion when reviewing <br />a proposed plat. Section 1005.020(d)(8) provides, in part, as <br />follows: <br />In any event, all subdivisions shall be required <br />to relate well with existing or potential adjacent <br />subdivisions. <br />33 <br />
