ORDINANCE NO. 191 <br />AN ORDINANCE AMENDING CHAPTER 2101, <br />PARK AVAILABILITY CHARGES, OF THE <br />MUNICIPAL CODE OF THE CITY OF LITTLE CANADA. <br />THE CITY COUNCIL OF LITTLE CANADA HEREBY ORDAINS AS FOLLOWS: <br />Section 1. <br />Chapter 2101. of the Municipal Code of the City of Little <br />Canada is hereby amended to read as follows: <br />2101. PARK AVAILABILITY CHARGES. <br />2101.010. PURPOSE. This ordinance is enacted to provide for <br />orderly, economic and safe development of land and urban services <br />and facilities, and to protect and promote the public health, safety <br />and general welfare of the inhabitants of the City of Little Canada. <br />2101.020. LAND DEDICATION FOR PUBLIC USE. In all subdivisions, <br />as defined by Minnesota Statutes 1980, Section 462.352, for residential, <br />commercial, industrial or other uses or as a planned unit development <br />which includes residential, commercial and industrial uses, or any <br />combination thereof, where the City Council deems it appropriate, <br />a reasonable portion of each proposed development shall be dedicated <br />to the public for public use as parks, playgrounds, public open <br />space or storm water holding pond areas, or, at the option of the <br />City, the person or firm proposing the development shall donate <br />to the City an amount in cash in lieu of land. The City Council in <br />determining the reasonable portion to be dedicated to the public <br />may take into consideration the open space, park, recreation or common <br />areas and facilities which the developer has provided for the ex- <br />clusive use of the residents of the development. The portion of <br />the total area which becomes dedicated pursuant to these provisions <br />shall be in addition to that land dedicated for streets, alleys, <br />easements and other public ways. No areas may be so dedicated for <br />public use without first having been approved by the City Council <br />as suitable for the public purposes enunciated in Section 2101.010 herein. <br />1. If the City Council, at its option, requires the developer to <br />dedicate land, a maximum of 10% of the total area to be subdivided shall <br />be dedicated for public use as parks, playgrounds, open space or storm <br />water holding pond areas. <br />2. If the City Council, at its option, requires the developer <br />to donate cash in lieu of land, the following criteria shall be applied: <br />50 <br />
