PAUL, MINNESOTA55102 <br />Pursuant to our telephone conversation on August 2, 1982, <br />I am writing to inform you of a state statute requiring the <br />creation of a local organization for civil defense. Minnesota <br />Statute Section 12.25, Subd. 1, specifically states as follows: <br />Each political subdivision of this state <br />shall establish a local organization for <br />civil defense in accordance with the state <br />civil defense plan and program, but no town <br />shall establish a local organization for civil <br />defense without approval of the state director. <br />Each local organization for civil defense shall <br />have a director who shall be appointed forth- <br />with in a city by the mayor thereof, in a town <br />by the town board, and for a public corporation <br />organized and existing under sections 473.601 <br />to 473.679 by its governing body who shall have <br />direct responsibility for the organization, <br />administration, and operation of such local <br />organization for civil defense, subject to the <br />direction and control of such governing body. <br />The language in the statute is mandatory that a political <br />subdivision establish such an emergency service organization. <br />Subdivision 5 of the same statute goes on to state that two <br />or more political subdivisions, which are contiguous may enter <br />into an agreement for a common defense program with the approval <br />of the governor. <br />r <br />
