<br />installation of the aforementioned improvements within the plat, in-
<br />cluding, but not limited to, the actual costs of construction of said
<br />improvements, engineering fees, legal fees, inspection fees, interest
<br />fees, costs of acquisition of necessary easements, if any, and any
<br />other related costs incurred by the City.
<br />(a) The watermain improvement shall consist of a watermain loop
<br />from Ryan Lane to Spruce Street. The Developer and the City agree
<br />that the estimated cost of the watermain improvement is $9,000.00,
<br />which shall be assessed against Lot 1, Block 1, Ryan Industrial
<br />Park, Lot 1, Block 3, Ryan Industrial Park, and Lot 5, Block 3,
<br />Ryan Industrial Park. The assessment shall be amortized over
<br />a 15 year term, pursuant to Minn. Stat. Chapter 429.
<br />(1) The Developer is the owner of Lot 1, Block 3, Ryan
<br />Industrial Park and Lot 5, Block 3, Ryan Industrial Park.
<br />The Developer would receive notice of a special assessment
<br />hearing for Little Canada Improvement Project 81 -11 as to
<br />Lots 1 and 5, Block 3, Ryan Industrial Park, which hearing
<br />will be held by the Little Canada City Council in the fall
<br />of 1982, at Little Canada City Hall.
<br />(2) The Developer hereby stipulates and agrees that the
<br />special assessments of $3,000.00 against Lot 1, Block 3,
<br />Ryan Industrial Park, and against Lot- 5, Block 3, Ryan
<br />Industrial Park, are reasonable and are based upon and
<br />do not exceed the benefits received by the subject property
<br />by reason of Little Canada Improvement Project 81 -11.
<br />(3) The Developer hereby stipulates and agrees that the
<br />special assessment of $3,000.00 will be levied against
<br />Lot 1, Block 3, Ryan Industrial Park, and the special
<br />assessment of $3,000.00 will be levied against Lot 5,
<br />Block 3, Ryan Industrial Park, and will constitute liens
<br />on the subject property, in accordance with Minn. Stat.
<br />Section 429.061.
<br />(4) The
<br />right to
<br />on Lot 1,
<br />pursuant
<br />respects
<br />Developer hereby stipulates and agrees that any
<br />appeal from the special assessments of $3,000.00
<br />Block 3, and Lot 5, Block 3, Ryan Industrial Park,
<br />to Minn. Stat. Section 429.081, is waived in all
<br />and in all events.
<br />(b) The street improvement shall consist of a bituminous overlay
<br />on Ryan Drive from Country Drive to Ryan Lane. The Developer and
<br />the City agree that the estimated cost of this street improvement
<br />is $17,000.00, which shall be divided by three and assessed against
<br />Lot 1, Block 3, Ryan Industrial Park, Lot 2, Block 1, Ryan Industrial
<br />Park, and Lot 3, Block 1, Ryan Industrial Park. The assessment of
<br />$5,667.00 against each lot shall be amortized over a 15 year term,
<br />pursuant to Minn. Stat. Chapter 429.
<br />(1) The Developer is the owner of Lot 1, Block 3, Ryan
<br />Industrial Park, and Lot 2, Block 1, Ryan Industrial Park
<br />and Developer is the contract vendor of Lot 3, Block 1,
<br />Ryan Industrial Park. The Developer will receive notice of.
